SOSトーチャー国際事務局は、SOSトーチャー・ネットワークの一員である法律扶助協会(LAS)より、2005年8月28日に逮捕されてエレーナ・ウルレバさんが、現在、精神科医のクリニックで拘束されているという情報を得ました。彼女の弁護士であるヴィアトレイ・クラシォフスキーさんは、まだ彼女に面会できていないし、ウルレバさんが拘束されている医院の医者は、裁判所の決定に従い、強制的に治療を受けていると述べています。
SOSトーチャーは、エレーナ・ウルレバさんの心身の安全を深く懸念しています。
<これまでの状況>
SOSトーチャー国際事務局はネットワークの一員である法律扶助協会(LAS)より、野党Ozod Dehkonlarの党員であるエレーナ・ウルレバさんが、2005年8月28日タシュケントで、ウズベキスタンの国の紋章が書かれた漫画を掲載したチラシを配布していたことで逮捕され、虐待されているという情報を受けました。
情報によれば、ウルレバさんは長時間にわたる尋問を受け、水も食べ物を与えられませんでした。また、弁護士との接見も拒否されました。報告によれば、彼女は、ウズベキスタンの政治体制を転覆させようとしたと書いた陳述書に無理やり署名をさせられたようです。
<行動要請>
ウズベキスタン関係当局に以下の内容の要請をお願いします。
- エレーナ・ウルレバさんの心身の安全を保障するために必要な措置はすべてとること。
- 正当な起訴理由がない中、彼女の即時釈放を命じること。もしそのような起訴理由があるならば、彼女を迅速で公正な裁判に付し、その間常に、弁護士との接見も含め、彼女の手続上の権利を保障すること。
- 責任者を特定し、裁判に付し、法に基づき刑事罰あるいは行政罰を適用できるよう、これら事件の情況について、とりわけ虐待の申し立てについて、綿密で中立な調査を行うよう命じること。
- 国際人権基準に従い、人権尊重と基本的自由を国内全体で保障すること。

Dear President Karimov,
I am writing you to express my concern over the detention of Mrs Elena Urlaeva at a psychiatric clinic in Tashkent. As he has been denied her access to her lawyer, I would like to urge you the followings:
- Take all necessary measures to guarantee the physical and psychological integrity of Mrs. Elena Urlaeva;
- Order her immediate release in the absence of valid legal charges, and if such charges exist, to ensure that she is given a prompt and fair trial, in which her procedural rights are guaranteed at all times, including access to her lawyer;
- Order a thorough and impartial investigation into the circumstances of these events, notably the allegations of ill-treatment, in order to identify those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law;
- Guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with international human rights standards.

Forced psychiatric internment

The International Secretariat of OMCT requests your URGENT intervention in the following situation in Uzbekistan.
New Information
The International Secretariat of OMCT has been informed by the Legal Aid Society (LAS), a member of the OMCT network, that Mrs. Elena Urlaeva, arrested in Tashkent on 28th August 2005, is currently detained in a psychiatric clinic. Her lawyer, Viatly Krasilovsky, has not been able to see her and reported that a doctor of the department where Mrs. Urlaeva has been placed stated that she is on compulsory treatment according to a court decision.
OMCT is gravely concerned for the physical and psychological integrity of Mrs. Elena Urlaeva.
Brief reminder of the situation
The International Secretariat of OMCT was informed by the Legal Aid Society (LAS), a member of the OMCT network, of the arrest and ill-treatment of Elena Urlaeva, member of the opposition party, "Ozod Dehkonlar", in Tashkent on 28th August 2005, for disseminating leaflets containing cartoons of the state emblem of Uzbekistan.
According to information received, Mrs. Urlaeva has undergone continuous interrogation and has not been given any food or water. She has also not had any access to her lawyer. She was reportedly being forced to sign a document in which she admits that she tried to overthrow the political system of Uzbekistan.
Action requested
Please write to the authorities in Uzbekistan urging them to:
- Take all necessary measures to guarantee the physical and psychological integrity of Mrs. Elena Urlaeva;
- Order her immediate release in the absence of valid legal charges, and if such charges exist, to ensure that she is given a prompt and fair trial, in which her procedural rights are guaranteed at all times, including access to her lawyer;
- Order a thorough and impartial investigation into the circumstances of these events, notably the allegations of ill-treatment, in order to identify those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law;
