人権団体が様々な嫌がらせ行為を受けています。
「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、カザフスタンにおける以下の状況に関して、皆様の緊急の働きかけをお願いします。
<事件の概要>
人権擁護家のための監視機構はキルギス人権委員会(KCHR)より、「カザフスタン人権および法の支配のための国際事務局(KIBHR)」が窃盗やその他の嫌がらせにあっているという情報を入手しました。
入手した情報によると、2005年8月13日から14日にかけての週末、アルマティにあるKIBHRの事務所に空巣が入りました。KIBHRのメンバーは、液晶モニター6枚とプロセッサー13台が盗まれたことに気づきました。プロセッサーにはKIBHRの活動の情報すべてが入っていました。しかし、ファックスや電話、印刷機のような他の金品は盗まれておらず、犯行者はKIBHRの活動に関する情報だけを探していたのではないかと危惧されています。
現在、アルマティ警察と内務省ボスタンディク地方局職員がこの窃盗事件を調べています。
さらにKIBHRは最近、ある国会議員がKIBHRを含む30団体くらいのNGOに関して要請を行ったアルマティ市検察の査察を受けました。KIBHRに対する調査は2005年3月9日に始まりました。KIBHRはカザフスタンの野党の活動に資金援助した疑いをもたれています。この査察の結果はまだ伝えられていません。
2005年3月にはKIBHRの会計に対するアルマティ市税金委員会の調査が始まりました。同委員会は、KIBHRが「開かれた社会研究所」と「ソロス・カザフスタン財団」からもらった助成金に関して脱税が発覚されたと申し立てています。2003年の税務調査と、2003年と2004年の監査では何も見つからなかったのに、今回の調査では、税金の滞納があるとされました。しかし、この税金はこれまで支払いを求められたことのないものです。KIBHRは最終的な結論と追徴金の通知を待っています。
監視機構は、KIBHRが数年前から同じような出来事に直面していることを想起します。KIBHRの前の事務所は1999年に火事にあいました。消防署が原因を放火と特定した後、捜査が行われましたが、事件は未解決のままです。
さらに、KIBHRメンバーのセルゲイ・ドゥヴァノフさんが、未成年者をレイプしたという罪状で、2003年3月に3年半の禁固刑となっています。裁判所が彼の減刑を命じ、2004年1月には仮釈放され、2004年8月には最終的に無罪となっています。(監視機構2004年度報告を参照)
監視機構は、これらは1998年12月9日に国連総会が採択した「人権擁護家保護のための宣言」の全条文、とりわけ、「すべての者は、個々にまた他の者と共同して、国内、国際レベルにおいて人権および基本的自由の保護ならびに実現を伸長、奨励する権利を有する」とした第1条に甚だしく違反していると考えます。
<行動要請>
カザフスタン関係当局に以下の内容の要請をお願いします。
- いかなる情況にあろうとうも、カザフスタン人権および法の支配のための国際事務局 (KIBHR)のメンバーと、その他すべてのカザフスタンの人権擁護家の心身安全を保障すること。
- KIBHRの事務所の盗難事件と1999年の放火事件に関して、責任者を特定して、裁判に付し、罪の重大さに応じた判決を出すために、公正で中立、独立の調査を実施すること。
- KIBHRおよびカザフスタンのその他すべての人権団体に対するあらゆる形態の嫌がらせ行為に終止符を打つこと。
- 人権擁護家に関する宣言、とりわけ、上記に述べた同第1条と、「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項を遵守すること。
- 世界人権宣言とカザフスタンが批准したその他すべての国際人権文書にしたがい、人権尊重と基本的自由を保障すること。

Dear President Nazarbaev,
I am writing you to express my concern over the reported robbery in the office of the KIBHR and other related events. I would like to urge you the following:
- To guarantee in all circumstances the physical and psychological integrity of the members of the Kazakhstan International Bureau for Human Rights and the Rule of Law and all other Kazakh human rights defenders;
- To conduct a fair, impartial and independent inquiry into the robbery of the KIBHR office and the 1999 arson, in order to identify those responsible, bring them to justice and pronounce sentences proportional to the gravity of their crimes;
- To put an end to all acts of harassment against the KIBHR and all other human rights organisations in Kazakhstan;
- To comply with the Declaration on Human Rights Defenders, in particular the above-mentioned article 1 and article 12.2 that states that "The State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration";
- To guarantee the respect of human rights and fundamental freedoms in accordance with the Universal Declaration on Human Rights and other international instruments ratified by Kazakhstan.

Break-in and Robbery/ Harassment

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), requests your urgent intervention in the following situation in Kazakhstan.
Brief description of the situation:
The Observatory has been informed by reliable sources, among them the Kyrgyz Committee for Human Rights (KCHR), of the robbery and other acts of harassment against the Kazakhstan International Bureau for Human Rights and the Rule of Law (KIBHR).
According to the information received, between August 13 and August 14, 2005, during the week-end, the office of the KIBHR in Almaty was robbed. Members of the organisation noticed that six LCD monitors and thirteen processors were stolen from the office. The latter contained all the information about the association's activities. However, no other valuables such as a fax machine, telephones or printers have been stolen, which raises fears that the robbers were only looking for information related to the activities of the organisation.
Presently, the Almaty criminal police and representatives of the department of internal affairs of Bostandyk region are investigating into the robbery.
In addition, the organisation has recently been subjected to a verification by the Almaty City Prosecutor's Office, at the request of a member of the Parliament concerning about 30 NGOs, including the KIBHR. The investigation into the KIBHR started on March 9, 2005. The organisation is suspected to finance activities of the political opposition in Kazakhstan. The conclusion of the verification has not been yet communicated.
In March 2005, another investigation into the KIBHR's accounts was initiated by the Almaty Tax Committee. It allegedly found tax irregularities in grants received from the Open Society Institute and the Soros-Kazakhstan Foundation. Although a tax inspection carried out in 2003 and audits in 2003 and 2004 had found no irregularities, the current investigation immediately found the KIBHR had failed to pay due taxes that had never been requested before. The organisation currently awaits the final results on the taxes and fines to pay.
The Observatory recalls that the KIBHR already faced incidents in previous years. The bureau's former premises in Almaty were set on fire in 1999. A criminal investigation was initiated after the fire-police found it was an arson but the case remains unsolved.
Moreover, Mr. Sergei Duvanov, a member of the KIBHR, had been sentenced in March 2003 to 3 and a half years in prison on charges of raping a minor. After a court order to reduce his sentence, he was provisionally released in January 2004 and in August 2004 he was finally acquitted (See Observatory Annual Report 2004).
The Observatory notes that these facts clearly contravene the provisions of the Declaration on Human Rights Defenders, adopted by the General Assembly of the United Nations on December 9, 1998, in particular article 1 which states that "everyone has the right, individually and in association with others, to promote and to strive for the protection and realization of human rights and fundamental freedoms at the national and international levels".
Actions requested:
Please write to the Kazakh authorities and ask them to:
- guarantee in all circumstances the physical and psychological integrity of the members of the Kazakhstan International Bureau for Human Rights and the Rule of Law and all other Kazakh human rights defenders;
- conduct a fair, impartial and independent inquiry into the robbery of the KIBHR office and the 1999 arson, in order to identify those responsible, bring them to justice and pronounce sentences proportional to the gravity of their crimes;
- put an end to all acts of harassment against the KIBHR and all other human rights organisations in Kazakhstan;
