昨年に続き人権組織が嫌がらせを受けています。
「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、グルジアにおける以下の状況に関して、皆様の働きかけをお願いします。
<事件の概要>
人権擁護家のための監視機構は人権情報・記録センター(HRIDC)より、同センターのウチャ・ナヌアシヴィリ執行理事が中傷と威嚇を受けているという情報を入手しました。
入手した情報によると、2005年9月27日にウチャ・ナヌアシヴィリさんはグルジア大統領府にあるグルジア離散者・民族間問題部の部長クヴァラツケリア・ザウールに電話をかけました。クヴァラツケリア・ザウール部長は電話でナヌアシヴィリさんを怒鳴り、侮辱し、彼のことを「内通者」、「裏切り者」と呼びました。クヴァラツケリア・ザウールによれば、HRIDCはグルジアの少数民族について虚偽の情報を流しており、外国勢力の意を受けているということです。
監視機構は、HRIDCが2004年11月にも複数の政府高官から何度か脅迫を受けたことを想起します。実際、大統領府法律部長兼首相顧問のニカナディナゼがHRIDCに電話して、難民の権利に関する活動をやめるよう言ってきました。彼はもしHRIDCがこの要請に従わなければ「問題が起きる」かもしれないとほのめかしました。また彼は、HRIDCが政治組織に属し、政府にとって問題を起こしていると非難しました。(監視機構の2004年度年次報告参照)
HRIDCは1996年に設立され、主にグルジアの人権状況の監視、拷問と差別の撲滅、グルジアの少数民族の権利や移民、人身売買、女性に対する暴力の監視などの活動をしています。
監視機構は、これらの中傷や脅迫行為は、グルジアの独立した人権擁護家に対する敵意という大きな文脈の中で起きていると考えており、これらの行為に対して深い懸念を表明します。また、これらの行為は1998年12月9日に国連総会が採択した「人権擁護家保護のための宣言」の全条文、とりわけ、「国家は、この宣言に掲げられた権利を正当に行使した結果としてのあらゆる暴力、脅迫、報復、事実上のあるいは法律上の敵意に満ちた差別、圧力、あるいはその他のあらゆる恣意的な行為に反対し、すべての者を、個々にまたは他の者と共同して、権限ある当局によって確実に保護するための、すべての必要な措置をとるべきである」とした第12条2項に甚だしく違反していると考えます。
<行動要請>
グルジア関係当局に以下の内容の要請をお願いします。
- ウチャ・ナヌアシヴィリさん、HRIDCの全メンバー並びに国内のすべての人権擁護家の心身の安全を保障すること。
- 人権擁護家に対するあらゆる形態の嫌がらせと誹謗中傷を止めること。
- 人権擁護家に関する宣言のすべての条項、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条と、上記に述べた第12.2を遵守すること。
- 国際人権基準およびグルジアが批准した国際人権文書に従い、いかなる場合においても、人権尊重と基本的自由を保障すること。

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), has received new information and requests your urgent intervention in the following situation in Georgia.
Brief description of the situation:
The Observatory has been informed by the Human Rights Information and Documentation Center (HRIDC) about acts of defamation and intimidation against Mr. Ucha Nanuashvili, HRIDC Executive Director.
According to the information received, on September 27, 2005, Mr. Ucha Nanuashvili had a telephone conversation with Mr. Kvaratskhelia Zaur, Head of the Department for Relations with Georgian Diasporas and Inter-Ethnic Relations at the Georgian President's Office. Mr. Kvaratskhelia Zaur shouted and hurled insults at him and called him an "informer" and "betrayer". According to Mr. Kvaratskhelia Zaur, HRIDC would be spreading false information about ethnic minorities in Georgia and would represent the interests of foreign forces.
The Observatory recalls that in November 2004, HRIDC had already received several threats from high rank officials. Indeed, Mr. Nicanadinadze, Head of the legal department of the State Chancellery and advisor to the Prime Minister, gave a phone call to HRIDC, in order to ask the centre to cease its activities concerning the right of refugees. He indicated that the Centre might "have problems" if it refused to comply. Mr. Nicanadinadze also accused HRIDC of belonging to a political organisation and causing trouble for the Government (See Annual Report 2004 of the Observatory).
HRIDC was founded in 1996 and its main activities include, among others, monitoring the human rights situation in Georgia, fighting against torture and discrimination, monitoring minority rights in Georgia, as well as migration, trafficking in human beings and violence against women.
The Observatory believes that these defamation and intimidation acts are part of a more general context of hostility against independent human rights defenders in Georgia and expresses its deep concern about these acts, recalling that they constitute flagrant violations of article 12.2 of the Declaration on Human Rights Defenders, adopted by the General Assembly of the United Nations on December 9, 1998, which states that "The State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration".

Please write to the Georgian authorities and ask them to:
- Guarantee, in all circumstances, the physical and psychological integrity of Mr. Ucha Nanuashvili, all HRIDC members, as well as all human rights defenders in the country as a whole;
- Put an end to all forms of harassment and defamation against human rights defenders;
