SOSトーチャー国際事務局は、ネパールにおける下記の状況に関して皆様の緊急の働きかけをお願いします。
＜事件の概要＞
SOSトーチャー国際事務局は、SOSトーチャーネットワークの一員である人権と民主主義のためのチベットセンター（TCHRD）より、ネパールにいるチベット難民のソナム・ツェリンさん（18歳）とノルブ・ツェリンさん（25歳）が恣意的に逮捕されたという情報を受けました。
情報によれば、ソナム・ツェリンさんは2005年10月7日頃カトマンドゥー到着後すぐに警察に捕まえられ、カトマンドゥーにあるディリィ・バタル刑務所に拘禁されています。
トン・シン・サング（中国当局が出す渡航許可証）を所持していたソナム・ツェリンさんは、夜の間にカトマンドゥーに到着し、同市内のスゥヤンブナタ地区で警察に逮捕されました。10月9日、ネパール内務省の移民局に身柄を引き渡されました。移民局は27，000ネパール・ルピー（約375米ドル）の罰金か、あるいは禁固3年を課しました。罰金を支払うことができないソナム・ツェリンは、結局、カトマンドゥーにあるディリ・バザール刑務所における禁固3年の刑を受けることになりました。ツェリンさんは、青海省ゴロ・チベット自治県に属していると考えられています。
同様のケースとして、25歳のノルブ・ツェリンさんは2005年9月24日、キドンにある彼の故郷の村に帰る途中、ネパールとチベットの国境で逮捕されました。9月28日にネパール移民局に身柄を渡された後、彼は罰金28，651ネパール・ルピーを課せられましたが、支払うことができないため、禁固3年3ヶ月を言い渡され、刑務所に収監されています。
さらには、2003年5月31日、ネパールは在ネパールの中国大使館から圧力をかけられ、ネパールにいた18人のチベット難民を国際世論を無視してチベットに送還しました。
SOSトーチャー国際事務局は、ソナム・ツェリンさんとノルブ・ツェリンさんの心身の安全を深く憂慮しており、中国に送還されるのではないかと危惧しています。
＜行動要請＞
ネパール関係当局に、以下の内容の要請をお願いします。
- ソナム・ツェリンさんとノルブ・ツェリンさんの心身の安全を保障すること。
- 有効な書類を所持していなかった事に対してまったく不均衡な拘束と判決の理由について明らかにすること。
- 国内法および国際人権基準に沿って、国内全体で人権尊重と基本的自由を保障すること。

I would like to urge you; to guarantee the physical and psychological integrity of Mr. Sonam Tsering and Mr. Norbu Tsering; to clarify the reasons for detention and the sentencing, which is completely disproportionate with their lack of valid papers; and to ensure the respect of human rights and fundamental freedoms throughout the country in accordance with national laws and international human rights standards.

Arbitrary arrest and detention
The International Secretariat of OMCT requests your URGENT intervention in the following situation in Nepal.
Brief Description of the Situation
The International Secretariat of OMCT has been informed by the Tibetan Centre for Human Rights and Democracy (TCHRD), a member of the network, of the arbitrary arrests of two Tibetan refugees, Sonam Tsering , 18 years old, and Norbu Tsering, 25 years old, in Nepal.
According to the information received. Mr. Sonam Tsering has been jailed in Dilli Bataar Jail in Kathmandu, following his arrest by the police upon arrival in Kathmandu around 7th October 2005.
Mr. Sonam Tsering, holding Tong Xin Thang (travel permit allowing him to travel to the border), arrived in Kathmandu during the night and was arrested in the Swayambunath area of Kathmandu by police. On 9th October he was handed over to the Immigration Department of the Nepalese Home Ministry. The Immigration Department imposed a penalty of Nepalese Rupees 27,000 (approx USD 375) or an imprisonment term of three years. Mr. Sonam Tsering was unable to pay the penalty and subsequently sentenced to three years in Dilli Bazaar Jail in Kathmandu, Nepal. Mr. Tsering is thought to belong to Golog Tibet Autonomous Prefecture, Qinghai Province.
In a similar case, Mr. Norbu Tsering, 25 years old, was arrested on 24th September 2005 on the Nepal-Tibet border whilst on his way back to his native village in Kyidong. After being handed over to the Nepalese Immigration Department on 28th September 2005, he was charged a penalty of Nepalese Rupees 28,651, which he failed to pay and consequently was sentenced to three years and three months in jail.
Furthermore, on 31st May 2003, Nepal deported 18 Tibetan refugees to Tibet under pressure from the Chinese Embassy in Nepal, in spite of a massive international appeal.
The International Secretariat of OMCT is gravely concerned for the physical and psychological integrity of Mr. Sonam Tsering and Mr. Norbu Tsering, and fears that they will be deported to China.
Action Requested:
Please write a letter to the authorities in Nepal urging them to:
- Guarantee the physical and psychological integrity of Mr. Sonam Tsering and Mr. Norbu Tsering;
- Clarify the reasons for detention and the sentencing, which is completely disproportionate with their lack of valid papers;
- Ensure the respect of human rights and fundamental freedoms throughout the country in accordance with national laws and international human rights standards.
