国内人権委員会が襲撃されました。

 「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、スリランカにおける下記の状況に関して皆様の緊急の働きかけをお願いします。

<事件の概要>

 人権擁護家のための監視機構は信頼できる情報筋より、コロンボにある人権委員会(HRC)の本部が襲撃されたという情報を入手しました。

 入手した情報によると、2005年10月12日の夜明けに、見知らぬ人々がHRCの事務所を襲撃し、荒らしました。襲撃者はファイルを破壊し、HRCの調査記録に火をつけ、その後、部屋中ガソリンをまいたそうです。

 事務所に来たHRCのメンバーはすぐに警察に行って被害届を出しました。犯罪捜査課(CID)がこの襲撃の捜査の担当になりました。

 人権委員会は国の人権機関であり、1997年に法律にもとづいて設立されました。HRCは公権力による人権侵害、とくに警察による被害の申し立てについて調査しています。また、憲法が保障する基本的権利を法手続きが遵守しているかどうかを調べ、法律制定や行政手続きにおいて基本的権利が守られるよう政府にアドバイスしています。

 監視機構は、この襲撃はスリランカ内での人権侵害の調査をやめさせるよう人権委員会メンバーを脅す試みであると考え、この事件に対して大きな懸念を表明します。

<行動要請>

 スリランカ関係当局に以下の内容の要請をお願いします。

  1. 人権委員会のすべての委員の心身の安全を保障し、それによって、委員会が外部の妨害を受けることなく本来の活動を遂行できるようにすること。
  2. 襲撃の実行者を特定し、裁判に付し、罪の重大さに応じた判決を言い渡せるよう、公正、中立、独立した調査を実施すること。
  3. 1998年12月8日国連総会が採択した人権擁護家に関する宣言の条項、とりわけ、「すべての者は、個々にまた他の者と共同して、国内、国際レベルにおいて人権および基本的自由の保護ならびに実現を伸長、奨励する権利を有する」とした第1条と、「国家は、この宣言に掲げられた権利を正当に行使した結果としてのあらゆる暴力、脅迫、報復、事実上のあるいは法律上の敵意に満ちた差別、圧力、あるいはその他のあらゆる恣意的な行為に反対し、すべての者を、個々にまたは他の者と共同して、権限ある当局によって確実に保護するためのすべての必要な措置をとるべきである」とした第12.2条にしたがうこと。
  4. いかなる情況にあろうとも、世界人権宣言およびスリランカが批准したその他の国際人権文書にしたがうこと。

I am writing you to express my concern at the report of attack on the office of the National Human Rights Commission of Sri Lanka on October 21, 2005. I would like to urge you the followings:

  1. To guarantee the physical and psychological integrity of all members of the Human Rights Commission, so that the organisation can carry out its activities without being subjected to outside hindrance;
  2. To conduct a fair, impartial and independent inquiry into this attack, in order to identify the actors, bring them to justice and pronounce sentences proportional to the gravity of their crimes;
  3. To comply with the provisions of the UN Declaration on Human Rights Defenders, in particular article 1, which states that "everyone has the right, individually or in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels", and article 12(2), which provides that "the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually or in association with others, against any violence, threats, retaliation, de facto or de jure, adverse discrimination, pressure or any other arbitrary action as a consequence of his or legitimate exercise of the rights referred to in the present Declaration";
  4. To guarantee the respect of human rights and fundamental freedoms in accordance with the Universal Declaration on Human Rights and other international or regional instruments ratified by the Sri Lanka.

The Observatory for the Protection of Human Rights Defenders, a joint program of the International Federation for Human Rights (FIDH) and the World Organisation Against Torture (OMCT), requests your urgent intervention in the following situation in Sri Lanka.

Brief description of the facts :

The Observatory has been informed by reliable sources of the attack against the Human Rights Commission's (HRC) headquarters in Colombo.

According to the information received, on October 12, 2005, at daybreak, HRC's office was assaulted and searched by unknown persons. The assaulters destructed files and set fire on documents concerning the investigations conducted by the organisation. They also poured out some petrol throughout the office.

Immediately after their arrival in the office, the members of HRC went to the police station and lodged a complaint. The Criminal Investigations Department (CID) was charged of investigating into this attack.

The Human Rights Commission, a national human rights institution, was established by law in 1997. The HRC investigates into complaints on alleged violations of human rights caused by executive and administrative services, and notably those perpetrated by the police all around the country. It is also in charge of reviewing legal procedures to ensure compliance with the Constitutional guarantees of fundamental rights and of advising the government in formulating legislation and administrative procedures for the protection of fundamental rights.

The Observatory would like to express its high concern over this attack as it believes it constitutes an attempt to intimidate the Human Rights Commission's members, in order to incite them to stop their investigations into human rights violations in Sri Lanka.

Actions requested:

Please write to the authorities of Sri Lanka urging them to:

  1. Guarantee the physical and psychological integrity of all members of the Human Rights Commission, so that the organisation can carry out its activities without being subjected to outside hindrance;
  2. Conduct a fair, impartial and independent inquiry into this attack, in order to identify the actors, bring them to justice and pronounce sentences proportional to the gravity of their crimes;
  3.
