警察に逮捕され、収監されています。

<事件の概要>
SOSトーチャー国際事務局はSOSトーチャーネットワークのメンバーである国際自由労働組合連合(ICFTU)より、2005年12月17日の香港における抗議デモで大量逮捕者が出た後、14人がいまだ警察に収監されているという情報を受けました。14人は非合法な会合の容疑で収監されており、今後は警察への暴行というより重い容疑をかけられるかもしれません。彼らの裁判は12月23日に予定されています。
デモ参加者は、貿易政策の結果、貧困と失業が高まったことで抗議をしていた韓国の農民とその支援者たちでした。情報によれば、収監されている人々の大半は韓国人で、その中には韓国民主労総(KCTU)のメンバーが含まれます。14人の中には、クールオウド・ウェブと呼ばれる労働者のウェブサイトの台湾人1人、日本人2人、そして中国本土からの1人も含まれています。
SOSトーチャー国際事務局は、デモ参加者に対する警察の過剰な公権力行使や、催涙ガスや胡椒スプレイの使用があったという情報を受けています。報告より、約60人が警察の猛攻で負傷をし、3人が病院に連れていかれたことがうかがえます。さらに、受けとった情報によれば、収監されている人々の虐待も報告されています。
<行動要請>
中国関係当局に以下の内容の要請をお願いします。
- 14人の被拘禁者の心身の安全を保障するために、必要な措置をすべてとること。
- 正当な嫌疑がないため、彼らを即時釈放すること。もしそのような嫌疑があるならば、彼らを中立で公正な裁判に付すこと。
- 責任者を特定し、裁判に付し、法に基づいて刑事あるいは行政処罰を適用できるよう、この事件の情況と申し立てられている収監中の虐待について綿密で公平な調査を行うよう命じること。
- 国内法および国際人権基準に従い、国内における人権尊重と基本的自由を保障すること。

Dear President Jintao,
I am writing you to express my concern over the report of arrest and detention of 14 participants of the rally on December 17th. It is also reported that they were going to be tried on 23rd of December. I would like to urge you; to take all measures necessary to guarantee the physical and psychological integrity of the 14 detainees; to order their immediate release in the absence of valid charges or, if such charges exist, to order a thorough and impartial investigation into the circumstances of this event and the allegations of ill-treatment in custody, in order to identify those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law; and to guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international human rights standards.

The International Secretariat of OMCT requests your URGENT intervention in the following situation in The People's Republic of China.
Brief description of the situation
The International Secretariat of the World Organisation Against Torture (OMCT) has been informed by the International Confederation of Free Trade Unions (ICFTU), a member of the OMCT network, that 14 demonstrators are still being held in police custody in Hong Kong following mass arrests made during a protest rally on December 17th 2005. The 14 are being held on a charge of illegal assembly and may face the more serious charge of assaulting the police. They are due to face trial on December 23rd 2005.
The demonstrators were Korean farmers protesting at the rising poverty and unemployment they face as result of trade policies, and their supporters. According to the information received, most of those in custody are Korean, and include members of the Korean Confederation of Trade Unions (KCTU). The 14 also include one Taiwanese from a labour website called Coolloud web, two Japanese and one mainland Chinese.
OMCT has been informed of the excessive use of force by the police against the protestors, and of the use of tear gas and pepper spray. Reports suggest that about 60 people suffered injuries as a result of the heavy handed intervention of the police, and three had to be hospitalised. In addition, according to the information received, ill treatment of those in custody has also been reported.
Action requested
Please write to the authorities in the People's Republic of China urging them to:
- Take all measures necessary to guarantee the physical and psychological integrity of the 14 detainees;
- Order their immediate release in the absence of valid charges or, if such charges exist,
- Order a thorough and impartial investigation into the circumstances of this event and the allegations of ill-treatment in custody, in order to identify those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law;
- Guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international human rights standards.
