パレスチナ難民の人権のために活動している組織が
政治勢力より圧力および嫌がらせを受けています。

　「国際人権連盟」（FIDH）と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、レバノンにおける以下の状況に関して、皆様の緊急の働きかけをお願いします。

＜事件の概要＞

　人権擁護家のための監視機構はベイルートに本拠を置くパレスチナ人権機構(PHRO)より、同組織の理事長ガッサン・アブダラさんに対して誹謗中傷行為と脅迫が行われたという情報を受けました。

　受けとった情報によれば、ガッサン・アブダラさんとその他のPHROメンバーは、2005年11月より数回にわたり脅迫を受けてきました。とりわけ、2005年11月19日、PHROの理事であると名乗る複数の個人が、インターネット上においてアブダラさんとその他のPHROのメンバーを“裏切り者”と非難し、“国際諜報機関と通じている”“CIAの資金援助を受けているFIDH（国際人権連盟）や人種主義者のイスラエル人グループなどが含まれるネットワークに所属している”“非合法な資金源よりお金を受けとっている”などのメッセージを流しました。

　2005年11月26日、PHROはベイルートの民事裁判所に誹謗中傷であると訴えを起こしました。2005年12月7日、これら事件に対して調査が開始されました。

　情報によれば、これらの行為は11月25日に行われたアブダラさんと政党であるレバノン勢力の党首サミル・ギィアギィさんとの会談に関係しているようです。この会談はPHROの活動の枠内で行われたもので、PHROは１年以上前より、パレスチナとレバノンの対話の樹立を求めた“和解を導く真実”と題するプログラムにとりくんできました。この関係において、PHROはパレスチナおよびレバノン両者の重要人物やレバノンの意思決定者との会合を開いてきました。それは、これら様々な当事者が対話に至るプロセスをどのように捉えているのかを正しく理解し、将来の対話のために不可欠な要素であるとPHROが考えている何点かの問題に関して、これら当事者がどのような見解をもっているのかを知るための試みでした。

　この試みに対して、PHROはあらゆる種類の反応を政党をはじめとした様々なところから受けてきました。政党関係者の中には、アブダラさんとギィアギィさんとの会談と新聞で報道された申し立てについて独自の調査を行うことを決め、この目的でPHROの代議員たちを招集した人々がいると言われています。また、司法による調査を妨害しようとした人もいました。さらには、パレスチナ民衆戦線解放-総司令党（PFLP-GC）はPHROの安全スタッフの一人に、PHROの活動やメンバーの動きについて情報を提供するよう求めました。

　2005年12月7日、アブダラさんは、親シリア派のパレスチナ同盟諸政党（PFLP-GC、イスラム闘争運動-ハマス、イスラミック・ジハード、セィカ、闘う戦線、ファテ運動・インティファーダ、パレスチナ解放戦線の７党から成る）との会合に招かれ、ギィアギィさんとの会談およびPHROによる提訴について話し合いがもたれました。この会合で、PHROの代表者たちは意見を表明するチャンスを与えられず、インティファーダやPFLP-GCの代表者たちに侮辱され脅されたと伝えられています。

　監視機構はガッサン・アブダラさんとPHROのメンバーが置かれている状況に懸念を抱いています。監視機構は、PHROが独立した組織であり、レバノンにいるパレスチナ難民の権利の保護と促進に専念してきたことを想起します。したがって監視機構は、レバノン国家に、1998年12月9日国連総会が採択した人権擁護家に関する国連宣言、とりわけ、「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項を遵守するよう要請します。

＜行動要請＞

　レバノン関係当局に以下の内容の要請をお願いします：

  1. いかなる情況にあろうとも、ガッサン・アブダラさんとPHROのメンバーの心身の安全を保障すること。
  2. これら事件に対する調査の公平性、中立性そして独立性を保障すること。
  3. ガッサン・アブダラさんとPHROのメンバー、そしてレバノンの人権擁護家すべてに対するあらゆる嫌がらせや誹謗中傷の行為を止めさせ、彼らが自由に行動をして意見を表明できるよう保障すること。
  4. 人権擁護家に関する国連宣言、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第１条、「すべての者は、個々にまた他の者と共同して、すべての人権と基本的自由に関する意見、情報、知識を出版、発表もしくは他の者に伝える権利を有している」として第6条(b)、そして上記の第12条2項を遵守すること。
  5. 世界人権宣言およびレバノン共和国が批准したその他の国際人権文書に含まれている国際人権基準を遵守すること。

  1. To guarantee in all circumstances the physical and psychological integrity of Mr. Ghassan Abdallah, and all PHRO members;
  2. To ensure the fairness, the impartiality and the independence of the inquiry opened into these events;
  3. To put an end to all acts of slandering and harassment against Mr. Ghassan Abdallah and PHRO members and all human rights defenders in Lebanon and ensure they be able to act and express themselves freely;
  4. To comply with the UN Declaration on Human Rights Defenders, especially article 1, which states that "everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels", article 6(b), which states that "everyone has the right, individually and in association with others (...) to publish, impart or disseminate to others views, information and knowledge on all human rights and fundamental freedoms", and the article 12.2 which states; "the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration".
  5. To comply with international human rights standards included in the Universal Declaration on Human Rights and other international human rights instruments ratified by the Republic of Lebanon.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the International Federation for Human Rights (FIDH) and the World Organisation Against Torture (OMCT), requests your urgent intervention in the following situation in Lebanon.


Brief description of the situation:

The Observatory has been informed by the Palestinian Human Rights Organisation (PHRO), based in Beirut, of acts of slandering and intimidation against its Director General, Mr. Ghassan Abdallah.

According to the information received, Mr. Ghassan Abdallah and other PHRO members have been subjected to several acts of intimidation since November 15, 2005. In particular, on November 19, 2005, a public statement was released on the Internet by individuals who presented themselves as PHRO board members and who accused Mr. Abdallah and other PHRO members of "betrayal", and of "working with international intelligence", "belonging to networks like FIDH [which] is funded by the CIA and contains racist Israeli groups" , "receiving funding from illegal sources", etc.

On November 26, 2005, PHRO lodged a complaint before the Civil court in Beirut for slandering. On December 7, 2005, an investigation was opened into these events.

According to the information received, these acts seem to be linked with a meeting between Mr. Abdallah and Mr. Samir Geagea, the leader of the Lebanese Forces (political party), that took place on November 15, 2005, within the framework of the activities of PHRO, which has developed, since more than one year, a program entitled " Truth Leading to Reconciliation " aiming at establishing a Palestinian-Lebanese Dialogue. In this regard, PHRO organised meetings with both Palestinian and Lebanese figures and decision makers in Lebanon, in order to get a better understanding of how the dialogue process is conceived by these various actors, and to determine their views regarding several issues considered by PHRO as necessary components of any future dialogue.

Since this " event ", PHRO experienced a whole range of reactions coming, in particular, from political parties. Some of them reportedly decided to conduct their own investigation into the meeting between Mr. Abdallah and Mr. Geagea and into the allegations raised in the press release, and they convoked PHRO representatives to this aim. Some would also have attempted to interfere in the judiciary investigation. Moreover, the Popular Frontiers Liberation Palestine - General Command party (PFLP - GC) asked one of PHRO security staff to convey information to them about PHRO activities and about the movements of its members.

On December 17, 2005, Mr. Abdallah was invited to attend a meeting with the Pro-Syrian Palestinian Alliance Parties, which gathers 7 parties (PFLP-GC, Islamic Struggle Movement - Hamas, Islamic Jihad, Sae'ka, Struggling Frontier (Al-Nidal), Fateh Movement-Intefada and Palestinian Liberation Frontier), in order to discuss his meeting with Geagea and the complaint lodged by PHRO. During this meeting, PHRO representatives did not get the chance to express their opinion and were allegedly insulted and threatened by representatives of Intefada and PFLP-GC.

The Observatory expresses its concern about the situation of Mr. Ghassan Abdallah and PHRO members. The Observatory recalls that PHRO is an independent organisation dedicated to the defence and promotion of the rights of Palestinian refugees in Lebanon. Therefore, the Observatory urges the Lebanese State to comply with the UN Declaration on Human Rights Defenders, adopted on December 9, 1998 by the General Assembly, which states in particular in its article 12.2 that "the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration".

Actions requested:

Please write to the authorities of Lebanon urging them to:

  1. Guarantee in all circumstances the physical and psychological integrity of Mr. Ghassan Abdallah, and all PHRO members;
  2. Ensure the fairness, the impartiality and the independence of the inquiry opened into these events;
  3. Put an end to all acts of slandering and harassment against Mr. Ghassan Abdallah and PHRO members and all human rights defenders in Lebanon and ensure they be able to act and express themselves freely;
  4.
