人道組織のオフィスが家宅捜査され、
メンバーが逮捕され有罪判決を受けました。
SOSトーチャー国際事務局は、グルジアにおける下記の状況に関して皆様の緊急の働きかけをお願いします。
<事件の概要>
SOSトーチャー国際事務局はSOSトーチャーネットワークメンバーである「人権情報・記録センター(HRIDC)」より、2005年12月28日にチェチェン難民であり人道組織「希望(Imedi)」のメンバーであるマホメド・マハエフさんが、トビリシ市民事裁判所から3ヶ月の予防拘禁の決定を受けたという情報を入手しました。
入手した情報によると、2005年12月27日、マホメド・マハエフさんの所属する組織をテロ組織アルカイダと関係があると疑う内務省の特別作戦部が、マハエフさんを逮捕しました。「希望」も、「書類偽造」と「職務濫用」で訴えられました。以来、「希望」がパンキシ渓谷で行っていた人道的活動はすべて停止されています。
検事総長室はこの件を2005年7月から調査していたと言われています。2005年9月6日、検事総長室の職員がマハエフさんの自宅を強制捜査し、「希望」の仕事に関連するコンピューターや記録すべてを持ち去りました。それから「希望」は1ヶ月半、活動を停止しなければなりませんでした。金融監視部から提供された情報に基づき、2005年9月20日に刑事捜査手続きが開始されました。
2005年10月末、検事総長室の違法収入合法化特別部が、マハエフさんに書類をすべて返却しました。
マハエフさんは2003年4月に「希望」を設立し、グルジア内のチェチェン難民を支援し、人道援助を行う団体として登録しました。同団体はとくにチェチェンとグルジアの国境のパンキシ渓谷で活動していました。
SOSトーチャー国際事務局は、マホメド・マハエフさんの心身の安全を危惧します。
<行動要請>
グルジア関係当局に以下の内容の要請をお願いします。
- いかなる情況にあろうとも、マホメド・マハエフさんの心身の安全を保障すること。
- 国際法および国際基準に合致した正当な嫌疑が不在の中、彼を即時釈放すること。もしそのような嫌疑があるならば、彼を公平で資格のある裁判に付し、裁判中、彼の手続き上の権利を保障すること。
- いかなる情況にあろうとも、国際人権基準とグルジアが批准した国際文書に沿って、人権尊重と基本的自由を保障すること。

The International Secretariat of OMCT requests your URGENT intervention in the following situation in Georgia.
Brief description of the situation:
The International Secretariat of OMCT has been informed by the Human Rights Information and Documentation Center (HRIDC), a member of the OMCT network, about the condemnation by the Civil Court of Tbilisi of Mr. Mahomed Mahaev, Chechen refugee and member of the humanitarian organisation Imedi ("Hope"), to three months of preliminary imprisonment, on December 28, 2005.
According to the information received, on December 27, 2005, Mr. Mahomed Mahaev was arrested by members of the Special Operative Department of the Ministry of Internal Affairs as his organisation was believed to have links with the terrorist network Al Qaeda. Imedi was also accused of "falsification of documents", and of "abuse of duties". All humanitarian activities carried out by Imedi in the Pankisi gorge have since then been stopped
The General Procurer's Office is said to have been investigating the case since July 2005. On September 6, 2005, members of the General Prosecutor's Office had raided the flat of Mr. Makhaev, taking away computers and all documents linked to his work at Imedi. The organisation had then to stop its activities for one month and a half. On September 20, 2005, a criminal investigation procedure started, based on information provided by the financial monitoring department.
At the end of October 2005, the Special Department on the legalisation of illegal income of the General Prosecutor's Office returned all the documents to Mr. Makhaev.
Mr. Makhaev established and registered Imedi in April 2003 as an organisation assisting Chechen refugees in Georgia and providing them with humanitarian aid. The organisation has been in particular operating in Pankisi gorge, on Georgia's border with Chechnya.
OMCT fears for the physical and psychological integrity of Mr. Mahomed Makhaev.
Action requested:
Please write to the Georgian authorities and ask them to:
- Guarantee, in all circumstances, the physical and psychological integrity of Mr. Mahomed Mahaev;
- Order his immediate release in the absence of valid charges that are consistent with international law and standards, or, if such charges exist, bring him before an impartial and competent tribunal and guarantee his procedural rights at all times;
- Ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights standards and international instruments ratified by Georgia.
