刑事裁判で被告に対して四肢切断という
残虐で非人道的な刑罰が課せられました。
SOSトーチャー国際事務局は、スーダンにおける下記の状況に関して皆様の緊急の働きかけをお願いします。
<事件の概要>
SOSトーチャー国際事務局はSOSトーチャーネットワークメンバーである「スーダン拷問反対協会(SOAT)」より、2005年12月25日にザリンギー特別刑事裁判所がアブデラ・サリー・フサイン・モハメドさん(35歳)を1991年制定のスーダン刑法第130条「殺人」、167条「武装強盗(ヒラバ)」に基づき有罪とし、第168条「武装強盗に対する罰則(ヒラバ)」により右手と左足を切断する四肢切断刑に処すことを決定したという情報を入手しました。1991年制定のスーダン刑法はシャリア法に基づいています。
入手した情報によると、モハメドさんは当初、ザリンギーにあるアルヒサヒサ国内避難民(IDP)キャンプで国内避難民の所有物を略奪(ロバ3頭)し、その窃盗の際にファティマ・アダム・ハルーンさんを死亡させた嫌疑で、2005年6月3日に警官に逮捕され、拘禁されました。2005年9月7日、事件は特別刑事裁判所に委ねられました。同じ日に検察と弁護の陳述があり、モハメドさんは有罪となりました。
南ダルフール州と北ダルフール州の知事による1998年制定の非常事態法に従って設立されたこの特別裁判所は、武装強盗、国家反逆、薬物および不法妨害に関する犯罪を扱います。入手した情報によると、スーダンの司法大臣は、この特別裁判所は正しい司法手続きに従っていないことを公に認めています。
国際事務局は、国際的に認められた公平な裁判手続きと保障に対する違反があるため、アブデラ・サリー・フサイン・モハメドさんの権利は侵害されたと考えます。
さらに国際事務局は、あらゆる四肢切断刑と死刑は、世界人権宣言や国際人権法で宣言されている生命の権利および、拷問や残虐で非人道的、品位を傷つける扱いや刑罰を受けない権利をはじめとする人権を侵害する究極的なものとして、強く反対することを強調します。
<行動要請>
スーダン関係当局に以下の内容の要請をお願いいたします。
- アブデラ・サリー・フサイン・モハメドさんの心身の安全を保障すること。
- 判決を無効にし、公平な裁判に関して国際的に認められた基準に合致した条件の下に、再審が行われるよう保障すること。
- 再審で有罪と判定された場合、スーダンも締約国である国連拷問等禁止条約を含む国際人権基準にしたがって、処罰を課すよう保障すること。
- ダルフール特別裁判所は裁判手続や国際的に認められている公平な裁判基準と保障に従っていないため、同裁判所の使用を禁止すること。
- 国内法および国際人道法や人権基準に従い、国内全体で人権尊重と基本的自由を保障すること。

I am writing you to express my concern over the sentence given to Mr. Abdella Salih Hussain on December 25, 2005. As the sentence imposed on him is cruel and inhumane, I would like to urge you to guarantee the physical and psychological integrity of Abdella Salih Hussain Mohamed; to nullify the sentence and guarantee that a retrial under conditions which accord with internationally recognised standards for a fair trial; to guarantee that, in the event he is found guilty after a retrial, any punishment imposed be in accordance with international human rights standards including the UN Convention Against Torture, to which Sudan is a party; to prohibit the use of Special Courts in Dafour, as they fail to comply with judicial procedures or internationally recognised fair trial standards and guarantees; and to guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international humanitarian law and human rights standards.

Corporal punishment
The International Secretariat of OMCT has reqests your URGENT intervention in the following situation in Sudan.
Brief description of the situation
The International Secretariat of OMCT has been informed by the Sudan Organisation Against Torture (SOAT), a member of the OMCT network, that on 25th December 2005, Zalingy Special Criminal Court sentenced Abdella Salih Hussain Mohamed (35yrs) to cross amputation of his right hand and left foot, and to a total of six years imprisonment after convicting him under Article 130 (murder) and Article 167 (armed robbery Hiraba) and imposing sentence under Article 168 (Penalty for Armed Robbery - Hiraba) of the Sudanese Penal Code of 1991. The Sudanese Penal Code of 1991 is based on Sharia law.
According to the information received, Mr. Mohamed was initially arrested and detained by police officers in Zalingy on 3 June 2005 on suspicion of looting property (three donkeys) belonging to internally displaced persons (IDPs) and causing the death of Fatima Adam Haroun during the theft in Alhisahisa IDP camp in Zalingy. On 7 September 2005, the case was transferred before the Special Criminal Court. Following presentations by both the prosecution and defence, Mr. Mohamed was found guilty on the same day.
The Special Court, established in accordance with the State of Emergency Act 1998 by the Governors of Southern and Northern Dafour Provinces, deals with crimes of armed robbery, crimes against the state, as well as crimes relating to drugs and public nuisance. According to the information received, the Sudanese Minister of Justice has publicly admitted that the Special Courts are not following correct judicial procedures.
OMCT considers that Mr. Abdella Salih Hussain Mohamed's rights were violated due to breaches of internationally recognised fair trial standards and guarantees.
Furthermore, OMCT stresses that it is strongly opposed to any kind of amputation and the death penalty as an extreme form of cruel, inhuman and degrading treatment and a violation of the right to life, as proclaimed in the Universal Declaration of Human Rights and other international human rights instruments.
Requested Action:
Please write to the authorities in Sudan urging them to:
- guarantee the physical and psychological integrity of Abdella Salih Hussain Mohamed;
- nullify the sentence and guarantee that a retrial under conditions which accord with internationally recognised standards for a fair trial;
- guarantee that, in the event he is found guilty after a retrial, any punishment imposed be in accordance with international human rights standards including the UN Convention Against Torture, to which Sudan is a party;
- prohibit the use of Special Courts in Dafour, as they fail to comply with judicial procedures or internationally recognised fair trial standards and guarantees;
- guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international humanitarian law and human rights standards.
