軍の兵士により未成年の少女が射殺され、
もう一人がレイプされました。

 SOSトーチャー国際事務局は、コロンビアにおける下記の状況に関して皆様の緊急の働きかけをお願いします。

<事件の概要>

 SOSトーチャー国際事務局は信頼できる情報筋より、アンティオキア県東部のアルジェリア市の農村部で、コロンビア軍がスサナ・パトリシア・ガレアノ・ガレアノさん(17歳)を殺害し、別の14歳の少女をレイプしたと申し立てられているという情報を入手し、憂慮しています。

 情報によれば、2006年2月15日の午後12時半頃、メデジンに駐屯するコロンビア軍第4旅団のリオス副官が指揮をとる「フアン・デル・コラル」大隊が上述の地域の「エル・プラン」住宅街に現れました。彼らはゲリラメンバーを追跡していました。このゲリラは軍に殺害されましたが、名前は公表されていません。

 その後、兵士たちはその住宅街にあるガレアノ・ガレアノさんの家に侵入し、未成年の2人の少女に出くわしました。そのうちの1人は名前が公表されていない14歳の子どもで、もう1人が兵士たちに射殺された17歳のスサナ・パトリシアさんです。兵士たちはスサナ・パトリシアさんを射殺したのはゲリラだと家族を説得しようとしました。家族がこれを拒絶すると、兵士たちは「当局には射殺したのはゲリラだと言え」と命令しました。兵士たちはまた、事件の真相を他に話すと容赦しない、と家族を脅しました。

 情報によれば、スサナ・パトリシアさんの遺体は翌日まで自宅近くの牧場に放置されていたということです。その後、兵士たちの何人かが、検察に権限を認められたとして、法的手続きをとるためにソンソン市に遺体を運びましたが、「エル・プラン」地区はアルジェリア市の行政管轄区に入ります。その上、スサナ・パトリシアさんの親戚は、法執行官が関与しているという事実を暴露したために、自らの生命、身体に危険を感じています。

 情報によれば、この事件はアルジェリア市の農村部で起きている、民間人に対する軍の暴力事件の1つです。この事件の数日前の2006年2月12日、「ギタナ」住宅街で、ある兵士が農民の家に侵入し、14歳の少女を手渡すよう、要求しました。この兵士の名前は公表されていません。農民は拒否しましたが、この兵士は彼女を無理やり連行し、レイプしたということです。情報によれば、この未成年の少女の両親は、少女を守ろうとして抵抗した時に暴力をふるわれたということです。

 国際事務局はこれらの極度の暴力行為を非難し、コロンビア当局に対し、スサナ・パトリシアさんの家族全員とギタナ住宅街のレイプされた14歳の少女の家族の心身の安全を確保するために必要な措置を講じるよう要請します。国際事務局はまた、これらの事件について、徹底かつ独立、公平な捜査を命じるよう、政府に要請します。

 さらに国際事務局は、この地域の農民の安全を保障するため、国際法および国際人道法で規定されている「目標区別の原則」(注:軍事目標とそれ以外のもの−文民や非戦闘員−とを区別すること)の遵守を担当当局に命じるよう、コロンビア政府に要請します。

 国際事務局はコロンビアが、「すべての子どもが生命への固有の権利を有する」、「締約国は、子どもの生存および発達を可能なかぎり最大限に確保する」(第6条)と謳った子ども権利条約に加盟していることを想起します。同条約第37条のもと、「いかなる子どもも、拷問または他の残虐な、非人道的なもしくは品位を傷つける取扱いもしくは刑罰を受けない」という義務をコロンビアは負っています。同条約の第38条は「1.締約国は、武力紛争において自国に適用可能な国際人道法の規則で子どもに関連するものを尊重し、かつその尊重を確保することを約束する。 4. 締約国は、武力紛争下における文民の保護のための国際人道法に基づく義務に従い、武力紛争の影響を受ける子どもの保護およびケアを確保するためにあらゆる可能な措置をとる」と規定しています。

 さらに国際事務局は、「女性に対する暴力の撤廃に関する宣言」の第4条(c)項が「国家によってなされるか私人によってなされるかを問わず、女性に対する暴力行為を防止し、調査し、および国内法に従って処罰するために相当の注意を払うこと」と規定していることを想起します。

<行動要請>

 コロンビア関係当局に以下の内容の要請をお願いします。

  1. 未成年のスサナ・パトリシア・ガレアノ・ガレアノさんの家族並びに“ギタナ”でレイプされたと申し立てられている14歳の少女の家族の心身の安全を保障するために、必要な手段をすべて即時とること。
  2. 共に正規軍の兵士が犯したと報じられているスサナ・パトリシア・ガレアノ・ガレアノさんの殺害の情況、および申し立てられている“ギタナ”の14歳の少女のレイプ事件の情況について、責任者を特定し、裁判に付し、法律に基づき刑事あるいは行政罰を適用するために、綿密で独立した公平な調査を行うよう命じること。
  3. 国連人権高等弁務官事務所など、国際および地域人権機関による勧告に即時従うこと。
  4. 国際人権基準、とりわけ、コロンビアが批准している拷問等禁止条約と子どもの権利条約、並びに、女性に対する暴力撤廃宣言をはじめとした国際人権基準に沿って、国内における人権尊重と基本的自由を保障すること。

I am very much disturbed at the report of killing of the minor Susana Patricia Galeano Galeano and the rape of the 14-year-old girl in "Gitana." I, therefore, would like to urge you to immediately take all necessary measures to guarantee the physical and psychological integrity of the minor Susana Patricia Galeano Galeano's family, as well as of the family of the 14-year-old girl, allegedly raped in "Gitana"; to order a thorough, independent and impartial investigation into the circumstances of the murder of Susana Patricia Galeano Galeano, and the alleged rape of the other 14-year-old girl in "Gitana", both reportedly committed by forces of the regular army, in order to identify those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law; to immediately comply with the recommendations by international and regional human rights agencies, including the Office of the United Nations High Commissioner for Human Rights; and to guarantee the respect of human rights and fundamental freedoms throughout the country in accordance with international human rights standards, in particular the Convention Against Torture and the Convention on the Rights of the Child, both ratified by Colombia, as well as the Declaration on the Elimination of Violence against Women.

Murder of a girl / Alleged rape of another girl / Fear for the families' safety

The International Secretariat of the World Organisation Against Torture (OMCT) requests your VERY URGENT intervention in the following situation in Colombia.

Description of the situation:

The International Secretariat of OMCT is deeply concerned about the information received from reliable sources concerning the murder of a 17-year-old girl, Susana Patricia Galeano Galeano, and the alleged rape of another 14-year-old girl, by members of the Colombian army in the rural area of the municipality of Argelia, East of Antioquia Department.

According to the information received, on February 15, 2006, around 12.30 p.m., a group of soldiers from the battalion "Juan del Corral" of the Colombian regular army's Fourth Brigade, based in Medellin, and commanded by an adjutant named Rios, turned up in the set of houses "El Plan" of the above mentioned municipality, in pursuit of an alleged "subversive" (member of the guerrilla) whose name has not been disclosed yet, and whom they killed.

Later on the soldiers entered the Galeano Galeano family's house which is located in the same set of houses and came across two underage girls: a 14-year-old, whose name has not been disclosed yet, and a 17-year-old called Susana Patricia, whom they shot dead. The soldiers reportedly tried to convince her family that Susana Patricia had been shot by the "subversive". As the family denied this version of the facts, the soldiers ordered them to "(...) tell the authorities the girl had been shot by the guerrilla (...)". They also allegedly threatened members of the family so that they would not relate these facts as they really happened.

According to the information the corpse of Susana Patricia Galeano Galeano was left in a pasture near the house until the following day. Then some soldiers moved it to the municipality of Sonson in order to carry out the corresponding legal proceedings, claiming the office of the public prosecutor had entitled them to do so, even though the administrative district of "El Plan" lies within the jurisdiction of the municipality of Argelia. Moreover Susana Patricia Galeano Galeano's relatives are frightened and fear for their lives and their own integrity for having exposed facts involving law enforcement officers.

According to the information such a serious fact is but one more violent act perpetrated by the army against the civilian population in the rural area of the municipality of Argelia. Some days before, on February 12, 2006, in the set of houses called "Gitana", a soldier went into the house of a peasant family, whose name has not been disclosed yet, and demanded that their daughter, a 14-year-old girl, be handed over to him. The parents refused but the soldier took her away by force and allegedly raped her. According to the information received the underage girl's parents were also physically assaulted when they tried to prevent their child from being attacked.

The International Secretariat of OMCT condemns these utmost violent acts and urges the Colombian authorities to take the necessary measures to guarantee the security as well as the physical and psychological integrity of all members of Susana Patricia Galeano Galeano's family and of the 14-year-old allegedly raped girl's family in "Gitana", Argelia. OMCT also requests the government to order a thorough, independent and impartial investigation into the circumstances of all these exposed acts.

Moreover OMCT requests the Colombian government to order the competent authorities to ensure the protection of the peasant population in this area, thus abiding by the Principle of Distinction set out in International Law and particularly by the International Humanitarian Law (IHL).

The International Secretariat of OMCT recalls that Colombia is a State Party to the Convention on the Rights of the Child which, in its article 6, states that "every child has the inherent right to life" and that "States Parties shall ensure to the maximum extent possible the survival and development of the child". According to its article 37, Colombia is bound to make sure that "no child shall be subjected to torture or other cruel, inhuman or degrading treatment or punishment. (...)". And article 38 stipulates that "1. States Parties undertake to respect and to ensure respect for rules of international humanitarian law applicable to them in armed conflicts which are relevant to the child, and (...) 4. In accordance with their obligations under international humanitarian law to protect the civilian population in armed conflicts, States Parties shall take all feasible measures to ensure protection and care of children who are affected by an armed conflict."

Furthermore OMCT recalls that the Declaration on the Elimination of Violence against Women, in its article 4 (c), stipulates States should "Exercise due diligence to prevent, investigate and, in accordance with national legislation, punish acts of violence against women, whether those acts are perpetrated by the State or by private persons", which includes violence against girls.

Action requested:

Please write to the authorities in Colombia urging them to:

  1. immediately take all necessary measures to guarantee the physical and psychological integrity of the minor Susana Patricia Galeano Galeano's family, as well as of the family of the 14-year-old girl, allegedly raped in "Gitana";
  2. order a thorough, independent and impartial investigation into the circumstances of the murder of Susana Patricia Galeano Galeano, and the alleged rape of the other 14-year-old girl in "Gitana", both reportedly committed by forces of the regular army, in order to identify those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law;
  3. immediately comply with the recommendations by international and regional human rights agencies, including the Office of the United Nations High Commissioner for Human Rights;
  4. guarantee the respect of human rights and fundamental freedoms throughout the country in accordance with international human rights standards, in particular the Convention Against Torture and the Convention on the Rights of the Child, both ratified by Colombia, as well as the Declaration on the Elimination of Violence against Women.
