SOSトーチャー国際事務局はSOSトーチャーネットワークメンバーである「フィリピン被拘禁者救援委員会(TFDP)」より、4人の農夫、アドレアノ・オティダさん(39歳)、ジョセフ・オティダさん(24)、マラキアス・サンパンJr.さん(45)そしてジョシュア・バスティロさん(28)が今もタグム市のコンポステラバレー州刑務所で拘禁されているという情報を入手しました。全員、反乱と小火器の違法所持で起訴されています。
<事件の概要>
SOSトーチャー国際事務局はSOSトーチャーネットワークメンバーである「フィリピン被拘禁者救援委員会(TFDP)」より、2005年4月1日午前7時頃、4人の農夫、アドレアノ・オティダさん(39歳)、ジョセフ・オティダさん(24)、マラキアス・サンパンJr.さん(45)そしてジョシュア・バスティロさん(28)が、フィリピン国軍第60普通科大隊の隊員により恣意的に逮捕、拘禁され、拷問を受けたという報告を受けました。
情報によれば、4人は、アドレアノ・オティダの親戚の農場でとうもろこしの収穫を手伝った翌朝、帰宅途中に軍服を着た男性約10人に呼び止められました。兵士たちに、なぜここにいるのか質問された4人は、事情を説明しましたが、それはまったく無視されました。その代わり、兵士たちは彼らを反逆者だと決め付けました。
4人はそのまま逮捕され、バランガイ・キラディンに連れていかれました。そこで軍人たちは村人にこの4人を知っているかと尋ねました。住民たちは、彼らはこの付近の農夫だと言いましたが、軍人たちはその証言を無視しました。同日、午後2時頃、軍人たちは4人を第60普通科大隊分隊に連れて行き、そこで尋問をし、新人民軍(NPA)のメンバーであると強制的に認めさせ、同志の行方を自白するよう強要しました。午後4時、4人は北ダバオのアサンション、ドニャ・アンドレアにある第60普通科大隊の野営キャンプに移送され、目隠しされたまま房に拘禁され、殴られました。4月11日、男たちはラーク刑務所に移されました。4月13日、タグム市のコンポステラバレー州刑務所に移送される途中、4人はラーク町立病院で健康診断を受けました。4人全員に「健康状態良好」とした証明書が発行されました。しかし、実際は、医者は4人を診断することなく、証明書だけ出しました。
情報によれば、拘禁中、アドレアノ・オティダは右腹部と胸部を何度か殴られたと訴えています。ジョセフ・オティダは床に横たわるよう命じられ、そのまま軍人たちに顔をけられ、背中に乗られ、腕を後手でねじられ、右耳近くで銃を発砲されました。拘禁中、彼はまた腹部を何度も殴られています。マラキアス・サンパンJrさんは、拘禁中、何度も胸にパンチを入れられ、銃床で胸を突かれたこと、そして体の左半分や脚を固い物体で殴られ、大きな石を足に落とされたと述べています。ジョシュア・バスティロさんは、胸や腹を殴られたと述べています。
情報によれば、4人は全員、10日間の拘留の最初の4日間で拷問を受けています。TFDPが刑務所で4人に面会をしたとき、拷問の痕ははっきりと分りました。
<行動要請>
フィリピン関係当局に以下の内容の要請をお願いいたします。
- アドレアノ・オティダさん、ジョセフ・オティダさん、マラキアス・サンパンJr.さん、そしてジョシュア・バスティロさんの心身の安全を保障すること。
- 国際法および国際基準と合致しない有効な合法的嫌疑がない中、これら4人の被拘禁者を即時釈放するよう命じること。もしそのような嫌疑が存在するなら、彼らを公正で資格ある法廷に出し、その間、彼らの手続き上の権利をすべて保障すること。
- 責任者を特定し、裁判に付し、法律に基づいて民事、刑事あるいは行政上の処罰を適用できるよう、4人の被拘禁者が受けた恣意的拘禁と拷問について綿密で公正な調査を命じること。
- 被害者が適正な補償を受けることができるよう保障すること。
- 国内法および国際人権基準にしたがって、国内における人権尊重と基本的自由を保障すること。

I would like to express my concern at the information about the continued detention of Mr. Adreano Otida (39), Mr. Joseph Otida (24), Mr. Malaquias Sampan Jr. (45), Mr. Joshua Bustillo (28), in Provincial Jail, Compostela Valley Province, Tagum City, since April 2005. As their detention is arbitrary and it has been a year, I would urge you the followings:
1. To ensure the physical and psychological integrity of Mr. Adreano Otida, Mr. Joseph Otida, Mr. Malaquias Sampan Jr., and Mr. Joshua Bustillo;
2. To order the immediate release of these four men in the absence of valid legal charges that are consistent with international law and standards, or, if such charges exist, bring them before an impartial and competent tribunal and guarantee their procedural rights at all times;
3. To order a thorough and impartial investigation into the arbitrary detention and torture of all four detainees, in order to identify all those responsible, bring them to trial and apply to them the civil, penal and/or administrative sanctions provided by law;
4. To guarantee that adequate reparation is provided to the victims;
5. To guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international human rights standards.

The International Secretariat of OMCT requests your URGENT intervention in the following situation in the Philippines.
New information:
The International Secretariat of OMCT has been informed by the Task Force Detainees of the Philippines (TFDP), a member of the OMCT network, that four farmers, Mr. Adreano Otida (39), Mr. Joseph Otida (24), Mr. Malaquias Sampan Jr. (45), Mr. Joshua Bustillo (28), are still being detained in Provincial Jail, Compostela Valley Province, Tagum City. All four men are charged with rebellion and with the illegal possession of firearms.
Reminder of the situation:
The International Secretariat of OMCT was informed by the Task Force Detainees of the Philippines (TFDP), a member of the OMCT network, of the arbitrary arrest, detention and torture of the four above mentioned farmers by members of the 60th Infantry Battalion of the Philippine Army on 1 April 2005, at about 7.00 am. According to the information received, the four men were on their way home, after spending the previous day helping a relative of Adreano Otida harvest corn, when they were stopped by about 10 men wearing military uniforms. The soldiers questioned them about why they were in the area but when the farmers provided an explanation it was ignored. Instead, the military officers accused them of being rebels.
The four men were then arrested and taken to Barangay Kilading village were the officers asked the residents if they recognized the men. The residence identified them as local farmers, however, the officers ignored this identification. At about 2.00 pm, the officers took the four men to the 60th IB Detachment where they were interrogated, forced to admit they were members of a rebel group named the New Peoples Army, and coerced into confessing the whereabouts of their supposed comrades. At 4.00 pm, the men were transferred to the 60th IB Camp in Do?a Andrea, Asuncion, Daveo del Norte where they were blindfolded, placed in a detention cell and mauled. On April 11, the men were taken to Laak Jail. Before being transferred on April 13 to the Compostela Valley Provincial Jail in Tagum City, the four men were taken to Laak Municipal Hospital for medical examinations. Medical certificates were issued for all men stating that they were in “good condition”, however, the doctor did not conduct any examinations before preparing the certificates.
According to the information received, while in the detention cell, Adreano Otida claimed that he was punched on the right side of his body, chest and abdomen several times. Joseph Otida was forced to lie on the ground after which time the officers kicked him in the face, his back was stamped on several times, his arms were twisted behind his back, and a gun was fired close to his right ear. While in detention, he was also punched in the abdomen several times. While in the detention cell, Malaquais Sampan Jr. stated he was punched in his chest several times, hit with a riffle butt on his chest, the left side of his body and legs were hit with a hard object, and his feet were hit with a large stone. While in the detention cell, Joshua Bustillo stated that he was punched in his chest and stomach.
According to the information received, all four men were tortured for the first four days of their detention. When TFDP interviewed the men in jail, traces of abuse were apparent.
Action requested:
Please write to the authorities in the Philippines urging them to:
i. Ensure the physical and psychological integrity of Mr. Adreano Otida, Mr. Joseph Otida, Mr. Malaquias Sampan Jr., and Mr. Joshua Bustillo;
ii. Order the immediate release of these four men in the absence of valid legal charges that are consistent with international law and standards, or, if such charges exist, bring him before an impartial and competent tribunal and guarantee his procedural rights at all times;
iii. Order a thorough and impartial investigation into the arbitrary detention and torture of all four detainees, in order to identify all those responsible, bring them to trial and apply to them the civil, penal and/or administrative sanctions provided by law;
iv. Guarantee that adequate reparation is provided to the victims;
