子どもを人権侵害から守る団体の代表が恣意的な裁判にかけられようとしています。

 「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、ブラジルにおける下記の状況に関して皆様の緊急の働きかけをお願いします。

<事件の概要>

人権擁護家のための監視機構は信頼できる情報筋より、拘禁されている子どもたちに対する人権侵害と闘っている「危機にさらされている子どもと青少年の母親と友人たち」という団体の創設者で代表であるコンセイサン・パガネレさんに対する刑事手続きが開始されたという情報を入手しました。

情報によれば、2006年4月18日、サンパウロ州の未成年犯罪者の拘禁を担当する未成年者収容施設(FEBEM)の内務局が、子どもの被拘禁者に対する集団拷問を何回か非難した彼女を「危害」(刑法第163条)、「犯罪煽動」(同第286条)、「陰謀」(同第288条)、「逃亡の煽動と幇助」(同第351条)で告発しました。この告発に基づき、パガネレさんに対する警察の捜査が始まり、彼女はこれらについて2006年5月12日に説明するように、と召喚されました。

この手続きの前に、すでに警察は2005年11月23日と2006年4月4日にFEBEM で起きた暴動に関連して彼女に対する捜査を行っています。2006年3月31日、UI-19ユニットの職員が事件報告書を申し立て、パガネレさんを「傷害」(「人に傷害を負わせ、その人々の尊厳もしくは品位を傷つける」ことに対する処罰を定める刑法第140条)で告発しました。

パガネレさんは2005年1月にFEBEMのUI41ユニットで起きた人権侵害を公然と非難し、それによりFEBEMの職員20人が刑務所に送られた後、深刻な脅迫を受けています。彼女はまた中傷キャンペーンにさらされています。例えば、サンパウロ州の当時のジェラルド・アルキミン知事は2005年11月23日に「グロボ・オンライン」のインタビューでFEBEM施設の状況について問われ、パガネレさんが「問題を起こしている」と非難しました。

監視機構はFEBEM施設の非人道的な状況や組織的暴力は、「拷問、略式処刑、および裁判官と弁護士の独立性に関する国連特別報告者」を含む国際社会から広く非難されていることを想起します。その他、2005年11月には米州人権裁判所がブラジル当局に対し、「未成年被拘禁者が残虐で非人道的、品位を傷つける扱いを受けないように、遅滞なく、必要な措置を講じるよう」命じています。

パガネレさんは2001年にフェルナンド・エンリケ・カルドーゾ大統領から国家人権賞を授与されています。2003年には、サンパウロのFEBEM施設の監視と人権促進の活動を評価された彼女の団体が、ホセ・アレンサール大統領代行から同じ賞を授与されています。

監視機構はパガネレさんに対する司法的嫌がらせを非難し、ブラジル当局に対し、彼女の人権擁護家としての役割に制裁を加えようとするこの恣意的な起訴をただちに取り下げるよう要請します。

<行動要請>

 ブラジル関係当局に以下の内容の要請をお願いいたします。

  1. パガネレさん並びにブラジルのすべての人権擁護家の心身の安全を保障すること。
  2. 司法的な迫害を含み、彼女に対するあらゆる種類の弾圧を阻止すること。
  3. 1998年12月9日に国連総会が採択した人権擁護家に関する宣言、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条と、「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項に従うこと。
  4. 世界人権宣言とブラジルを拘束する国際および地域的人権文書に従うこと。

    I am writing you to express my concern over the report of the judicial harassment against Mrs. Paganele of Associa??o de M?es e Amigos da Crian?a Adolescente em Risco ? AMAR. I would like to urge you the following:

    1. To guarantee the physical and psychological integrity of Mrs. Paganele, as well as of all human rights defenders in Brazil;
    2. To prevent any kind of repression against her, including judicial persecution;
    3. To comply with the Declaration on Human Rights Defenders, adopted by the General Assembly of United Nations on December, 9 1998; in particular its article 1 that states “everyone has the right, individually and in association with others, to promote and to strive for the protection and realization of human rights and fundamental freedoms at the national and international levels”, as well as article 12.2., which states that “the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration”;
    4. To conform to the Universal Declaration of Human Rights and international and regional instruments relative to human rights, binding Brazil.

    URGENT APPEAL ? THE OBSERVATORY

    The Observatory for the Protection of Human Rights Defenders, a joint programme of the International Federation for Human Rights (FIDH) and the World Organization Against Torture (OMCT) requests your urgent intervention in the following situation in Brazil.


    Brief description of the situation:


    The Observatory has been informed by reliable sources of criminal proceedings opened against Mrs. Concei?ao Paganele, President and Founder of the Association of Mothers and Friends of Children and Adolescents at Risk (Associa??o de M?es e Amigos da Crian?a Adolescente em Risco - AMAR), an organization involved in the fight against human rights violations committed on children in detention.


    According to the information received, on April 18, 2006, the Internal Affairs Office of the Foundation for the Well-Being of Minors (Funda??o do Bem-Estar do Menor ? FEBEM), a public agency of the State of Sao Paulo in charge of the detention of juvenile offenders, lodged a complaint against Mrs. Paganele for ? harm ? (article 163 of the Criminal Code), ? inciting a crime ? (article 286), ? conspiracy ? (article 288) and ? aiding and abetting an escape ? (article 351), after she denounced on several occasions collective acts of torture perpetrated against children detainees. On the basis of this complaint, a police investigation was launched against Mrs. Paganele, who was summoned to make clarifications on those facts on May 12, 2006.


    This new proceeding adds to other police investigations that have been opened against her in relation with investigations in two movements of rebellion in FEBEM detention centers on November 23, 2005 and April 4, 2006. On March 31, 2006, officials from the UI-19 Unit filed an incident report, in which they accused Mrs. Paganele of ?injury? (article 140 of the Criminal Code, which provides for sanction for “injuring a person, offending their dignity or decency”).


    In 2005, Mrs. Paganele had already received serious threats, after she publicly denounced, in January 2005, human rights violations in the FEBEM UI 41 Detention Unit, following which 20 FEBEM officials were sentenced to imprisonment. She was also targeted by defamation campaigns, as shown by the declarations of Mr. Geraldo Alckmin, then Governor of the State of Sao Paulo, who publicly accused Mrs. Paganele of ? creating problems ? when asked about the situation in the FEBEM centers in an interview to the Globo Online, on November 23, 2005.


    The Observatory recalls that the inhumane conditions of detentions and the systematic violence in the FEBEM centers have been widely condemned by the international community including the UN Special Reporters on Torture, Summary executions and on the Independence of Judges and Lawyers. Besides, in November 2005, the Inter-American Court of Human Rights ordered the Brazilian authorities to ? adopt without delay the necessary measures to prevent the juvenile detainees from being submitted to cruel, inhuman and degrading treatment ?.


    In 2001, Ms. Paganele received the National Human Rights Prize from President Fernando Henrique Cardoso. In 2003, her organization received the same honor, this time receiving the prize from the acting President, Jos? Alencar, for her work monitoring and promoting human rights at the FEBEM units in S?o Paulo.



    The Observatory strongly condemns these acts of judicial harassment against Mrs. Paganele, and call the Brazilian authorities to immediately drop the charges against her, as they are arbitrary and only aim at sanctioning her role as a human rights defender.


    Action requested:


    Please write to the Brazilian authorities and ask them to:


    1. guarantee the physical and psychological integrity of Mrs. Paganele, as well as of all human rights defenders in Brazil;
    2. prevent any kind of repression against her, including judicial persecution;
