No.3839    中国:上海の陳情者たちが、当局より不当な扱いを受け、その内2人は現在も拘束を解かれず、所在も明らかにされていません。

SOSトーチャー国際事務局は、中国における下記の状況に関して皆様の緊急の働きかけをお願いします。

<事件の概要>

SOSトーチャー国際事務局は信頼できる筋(1)より、2006年2月13日の晩、十数名の陳情者が米国外交官に会ったところ、2月15日以降、この上海の陳情者たちが虐待、恣意的拘禁、失踪などにあっているという情報を入手しました。(1)情報源は「中国人権(HRIC)」であるが、SOSトーチャーのネットワークメンバーではない。

情報によると、上海の陳情者、チェン・シャオミン(陳小明)さんは、2006年2月13日の晩に十数名の陳情者が集まるフー・ユーシャさんの家に米国外交官を連れて行ったと、公安局(PSB)により疑われています。2006年2月15日の晩、チェン・シャオミンさんは上海のルーワン地区公安局の警官十数名に拘禁され、自宅は2度家宅捜索を受けました。彼は当初公安局の倉庫で拘禁され、2006年3月6日に裸にされ、身体的な虐待を受けました。彼の助けを求める叫び声は外まで聞こえたということです。行方が分からなくなった後の2006年3月31日に、彼は首謀者として容疑者に指定されました。

その他、情報によれば、会合が行われた家のフー・ユーシャさんが2006年2月15日に拘禁されました。彼女は2006年3月5日に釈放されましたが、自宅軟禁におかれています。また、長期間にわたって陳情を続けており、外交官が来た晩にはフーさんの家にいなかったマ・ヤーリャンさんが2006年2月15日に友人の家にいたところを捕まえられ、2006年3月6日に釈放されるまで浦東新区のフェンキ・ホテルで拘禁され、十数名の警官に監視されました。マ・ヤーリャンさんは釈放された時、フアンプ公安局の警官に「自宅の監視は終ったが、拘禁されたことをメディアに口外してはならない、1年間は保釈中の身だ」と言われたということです。また外交官が来た晩にフーさんの家にいたハン・ゾンミンさんとその妻は監視され、ハン・ゾンミンさんは2006年2月16日に友人の家にいたところを捕まえられたということです。彼の妻は彼の失踪を警察に届け出ましたが、警察は何もしませんでした。彼の妻が2006年4月初旬にさらに問い合わせをしたところ、警察はハン・ゾンミンさんは拘禁され監視されていると言いましたが、逮捕状もなければ、何の嫌疑で拘禁されているのかも明らかにしませんでした。

国際事務局はその他の被拘禁者の情報は得ていません。

国際事務局はチェン・シャオミンさん、ハン・ゾンミンさん、フー・ユーシャさん、マ・ヤーリャンさんをはじめとする陳情者の心身の安全を深刻に懸念します。国際事務局は虐待の申し立てについて責任ある者を特定するために迅速で公平な調査に着手し、加害者を裁判に付し、法律に基づいて刑法上と行政法上の制裁を適用し、また被害者に適切な損害賠償を提供するよう、中国当局に要請します。


<行動要請>

 中国関係当局に以下の内容の要請をお願いします。

  1. チェン・シャオミンさんとハン・ゾンミンさんの所在を探しだし、チェン・シャオミンさんに医療支援を提供するよう保障すること。
  2. あらゆる情況において、陳情者の心身の安全を保障すること。
  3. 国際法と国際基準に一致しない正当な嫌疑がない中、チェン・シャオミンさんとハン・ゾンミンさんの即時釈放を命じ、フー・ユーシャさんとマ・ヤーリャンさんの自宅監視を止めるよう命じること。もしそのような嫌疑があるなら、彼女たちを公正で資格のある裁判に付し、その間中、彼女たちの手続上の権利を保障すること。
  4. 責任者すべてを特定し、裁判に付し、法律に基づいて刑事あるいは行政上の処罰を適用するために、これら事件について綿密で公正な調査を行うよう命じること。
  5. チェン・シャオミンさん、ハン・ゾンミンさん、フー・ユーシャさん、マ・ヤーリャンさん、そしてその他すべての被害者に、適切な補償を保障すること。
  6. 国内法および国際人権基準に沿って、国全体で人権尊重と基本的自由を保障すること。

    Dear President Hu Jintao,

    I would like to express my concern over the situation of Mr. Chen Xiaoming, Mr. Han Zhongming, Ms. Fu Yuxia and Ms. Ma Yalian, Shanghai petitioners who have been under the suspect of having brought an American diplomat to one of their houses on 13t February 2006. I would like to urge you the followings:

    1. To locate the whereabouts of Chen Xiaoming and Mr. Han Zhongming and ensure that Mr. Chen Xiaoming is provided with medical assistance;
    2. To guarantee, in all circumstances, the physical and psychological integrity of the petitioners;
    3. To order the immediate release of Mr. Chen Xiaoming and Mr. Han Zhongming and bring an end to the residential surveillance imposed on Ms. Fu Yuxia and Ms. Ma Yalian, in the absence of valid charges that are consistent with international law and standards, or, if such charges exist, bring them before an impartial and competent tribunal and guarantee their procedural rights at all times;
    4. To order a thorough and impartial investigation into these events, in order to identify all those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law;
    5. To guarantee that adequate compensation is awarded to Mr. Chen Xiaoming, Mr. Han Zhongming, Ms. Fu Yuxia and Ms. Ma Yalian, and to all other victims;
    6. To guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international human rights standards.

    Ill-Treatment / Arbitrary Detention / Forced Disappearence

    The International Secretariat of OMCT requests your URGENT intervention in the following situation in People's Republic of China.

    Brief Description of the Situation

    The International Secretariat of OMCT has been informed by a reliable source of the ill-treatment, arbitrary detention and forced disappearance of petitioners in Shanghai since 15 February 2006 following a meeting of more than a dozen petitioners with an American diplomat in the evening of 13 February 2006.

    According to the information received, the Public Security Bureau (PSB) suspects Shanghai petitioner Mr. Chen Xiaoming of bringing the American consular official to the home of petitioner Ms. Fu Yuxia in the evening of 13 February 2006 where a number of other petitioners had gathered. In the evening of 15 February 2006, Mr. Chen Xiaoming was detained by some dozen police officers from Shanghai's Luwan District Public Security Bureau (PSB) and his house was searched twice. It is reported that Mr. Chen Xiaoming was originally held in a storage room of the PSB station, and that in the middle of the night on 6 March 2006 he was stripped naked and physically abused, his cries for help audible from outside. It is alleged that on 31 March 2006, Mr. Chen Xiaoming was designated a key suspect after which his whereabouts remain unknown.

    Moreover, according to the information received, Ms. Fu Yuxia, in whose house the meeting took place, was detained on 15 February 2006. Although she was released on 5 April 2006, she is still kept under house arrest. Furthermore, it is reported that on 15 February 2006 long-time petitioner Ms. Ma Yalian, who was not present in Fu's home during the diplomat's visit, was detained while being at the home of a friend, and was held in the Fengqi Hotel in Pudong New District under the watch of a dozen police officers until her release on 6 May 2006. At the time of Ms. Ma Yalian's release, a police officer from the Huangpu PSB branch reportedly told her: "Your residential surveillance has been completed, but you must not talk to the media about your detention, and you remain released on bail for one year". Lastly, petitioner Mr. Han Zhongming and his wife, who were attending the meeting in Ms. Fu Yuxia's home during the diplomat's visit, were reportedly subjected to surveillance and monitoring, resulting in the detention of Mr. Han Zhongming on 16 February 2006, while he was also at a friend’s place. Mr. Han Zhongming's wife reported his disappearance to the police, but no action was taken. It is reported that when she made further enquiries at the beginning of April 2006 the police told her that Mr. Han Zhongming was being held under residential surveillance, but no warrant or other information regarding the charges under which Mr. Han Zhongming is being held has been provided.


    The International Secretariat of OMCT did not receive further information concerning the other petitioners.

    The International Secretariat of OMCT is gravely concerned for the physical and psychological integrity of the petitioners, especially of Mr. Chen Xiaoming, Mr. Han Zhongming, Ms. Fu Yuxia, and Ms. Ma Yalian. OMCT calls on the Chinese Government to immediately launch an impartial investigation into the allegations of ill-treatment, in order to identify those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law, as well as to provide adequate reparation to the victims of these abuses.

    Please write to the authorities in the People's Republic of China urging them to:

    1. Locate the whereabouts of Chen Xiaoming and Mr. Han Zhongming and ensure that Mr. Chen Xiaoming is provided with medical assistance;
    2. Guarantee, in all circumstances, the physical and psychological integrity of the petitioners;
    3.
