No.3862   ウズベキスタン:人権擁護活動家の大学生の息子が恣意的に逮捕され、拘禁されています。

「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、ウズベキスタンにおける下記の状況に関して皆様の緊急の働きかけをお願いします。

<事件の概要>

人権擁護家のための監視機構はウズベキスタン人権協会(HRSU)より、同人権協会ディザク支部の支部長バクティオル・カムロブさんの息子であり、ディザク工科大学の2年生であるイクティオル・

カムロブさんが恣意的に拘留されているという情報を受けました。

 情報によれば、2006年7月23日、イクティオル・カムロブさんがパンを買うために家を出たところ、若者の一団が彼を侮辱する言葉を投げかけてきました。彼はそれを無視して歩きつづけましたが、侮辱的な言葉はさらに乱暴になり、ついに暴力行為へ発展しました。イクティオル・カムロブさんと両親は、これら言動に対して当局に苦情を申し入れることはしないでおこうと決めました。

 それにもかかわらず、8月2日、ディザク警察はイクティオル・カムロブさんを逮捕し、弁護士との接見も認められないまま8時間以上尋問を受けました。そして、ウズベク刑事法第277号(第20章:公序犯罪)のもと、「フーリガン行為(乱暴行為)」で訴追されました。この罪の量刑は禁固5年から8年です。8月9日現在、彼はまだ拘禁されています。

 8月8日、バクティオル・カムロブさんはアクラム・イサモフ刑事に呼び出しを受け、彼の息子の事件の目撃者として事情聴取を受けました。

 監視機構は、イクティオル・カムロブさんの拘禁は、父であるバクティオル・カムロブさんの人権活動に対する制裁行為ではないかと深く憂慮しています。バクティオル・カムロブさんはその活動で、小自作農の権利擁護の立場から、モニター活動、裁判手続き、デモなどの行動を先導したり、ディザクの高官の入札会場で、市民に対する暴力や拷問を非難していました。そのため、監視機構はイクティオル・カムロブさんの拘禁は恣意的であると考えます。

 監視機構は、2005年5月22日に、バクティオル・カムロブさんの自宅が70人ほどの一団に侵入されて破壊されたことを想起します。それを指令したのは、ディジク地方行政の長であるウブディブラ・ヤマンクォブでした。バクティオル・カムロブさんと家族は殴られ、死の脅しと侮辱的な言葉を浴びせられました。

 監視機構は、ウズベキスタンの人権擁護家に対する系統的な弾圧と、とりわけ2005年5月13日のアンディジャン事件以降、彼らの状況が悪化し続けてきたことにあらためて深い憂慮を表明します。

<行動要請>

 ウズベキスタン関係当局に以下の内容の要請をお願いいたします。

1.いかなる情況にあろうとも、イクティオル・カムロブさんとバクティオル・カムロブさん、および彼らの家族の心身の安全を保障すること。

2.イクティオル・カムロブさんの拘禁は恣意的なため、即時無条件で彼を釈放すること。

3.カムロブさん親子およびウズベキスタンのすべての人権擁護家に対するあらゆる形態の嫌がらせを止めること。

4.1998年12月9日国連総会が採択した人権擁護家に関する国連宣言の条文、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条と、「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項を順守すること。

5.いかなる情況にあろうとも、国際人権基準とウズベキスタンが批准した国際文書に沿って、国内全体における人権尊重と基本的自由を保障すること。

Dear President Karimov,

I am writing you to express my concern over the detention of Mr. Ikhtior Khamroev who was arrested on August 2, 2006. I am afraid if his detention is related to his father’s involvement in the human rights activities of Human Rights Society of Uzbekistan. I would like to urge you the followings:

1. Guarantee in all circumstances the physical and psychological integrity of Messrs. Ikhtior Khamroev and Bakhtior Khamroev, and their family;


2 Release M. Ikhtior Khamroev immediately and unconditionally since his detention is arbitrary;

3. Put an end to all acts of harassment against them as well as all other human rights defenders in Uzbekistan;

4. Conform with the provisions of the UN Declaration on Human Rights Defenders, adopted by the General Assembly of the United Nations on December 9, 1998, especially its article 1, which states that “everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels” and article 12.2, which states that “the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration;


5. Ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights standards and international instruments ratified by Uzbekistan.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the International Federation for Human Rights (FIDH) and the World Organisation Against Torture (OMCT), requests your urgent intervention in the following situation in Uzbekistan.


Description of the situation:

The Observatory received information from the Human Rights Society in Uzbekistan (HRSU) about the arbitrary detention of Mr. Ikhtior Khamroev, the son of Mr. Bakhtior Khamroev, head of the Djizak section of HRSU, and a second-year student at the Technological University of Djizak.

According to the information received, on July 23, 2006, after he went out from his house in Djizak to buy some bread, a group of young men began to insult Mr. Ikhtior Khamroev. He tried not to care about them and continued to walk but the insults became more violent and Mr. Khamroev was then severely beaten by the men. Nor Mr. Ikhtior Khamroev nor his parents decided to complain about those acts.

However, on August 2, 2006 the police of Djizak arrested him and opened an inquiry against him by. Interrogated during more than eight hours without having access to a lawyer, he was then charged with “hooliganism” under article 277 of the Uzbek Criminal Code (Chapter XX: Crimes against public order), and is facing from 5 to 8 years of prison. At this date, he is still detained.

On August 8, 2006, Mr. Bakhtior Khamroev was summoned by Mr. Akram Isamov, a police investigator, to be interrogated as a witness in the case involving his son.

The Observatory expresses its deep concern about Mr. Ikhtior Khamroev’s detention, which appears to be aimed at sanctioning his father’s human rights activities. Mr. Bakhtior Khamroev’s work consists in leading actions such as monitoring, legal proceedings and demonstrations in favour of the rights of smallholders, as well as denouncing violence and torture committed against citizens at Djizak high-ranking officials’ bidding. In this regard, the Observatory considers Mr. Ikhtior Khamroev’s detention as arbitrary.

The Observatory recalls that, on May 22, 2005, the home of Mr. Bakhtior Khamroev had been broken into by a group of seventy people, under the orders of Mr. Ubdibulla Yamankulov, head of the Administration of the Djizak region. He and other members of his family had been beaten, threatened with death and insulted (See Observatory Annual Report 2005).

The Observatory reiterates its deepest concern regarding the systematic repression of human rights’ defenders in Uzbekistan and the constant deterioration of their situation, in particular since the events of Andijan occurred on May 13, 2005.

Actions required:


Please write to the Uzbek authorities urging them to:


i. Guarantee in all circumstances the physical and psychological integrity of Messrs. Ikhtior Khamroev and Bakhtior Khamroev, and their family;


ii. Release M. Ikhtior Khamroev immediately and unconditionally since his detention is arbitrary;

iii. Put an end to all acts of harassment against them as well as all other human rights defenders in Uzbekistan;

iv.
