No.3870    フィリピン:セブ州で2人の男性が私服の治安部隊員に恣意的に逮捕されました。

 SOSトーチャー国際事務局は、フィリピンにおける下記の状況に関して皆様の緊急の働きかけをお願いします。


<事件の概要>

 SOSトーチャー国際事務局はSOSトーチャーのネットワークのメンバー団体である「フィリピン被拘禁者救援組織(TFDP)」より、シャロン・アバンガさん(33歳)とゲラルド・ラバディアさん(35歳)が2006年9月1日に恣意的に逮捕され、拘禁されているという情報を入手しました。2人はセブ州タリサイ市のサウス・セントラル・マーケットで、セブ市内のキャンプ・ソテロ・カバフグを基地とするホセ・ホルヘ・コルプス本部長率いる犯罪捜査・探知第7グループ(CIDG-7)とセブ州内のキャンプ・ラプラプを基地とする軍情報部に逮捕されました。

 情報によると、シャロン・アバンガさんはタリサイ市シティオ・サルバドール・バランガイ・タンケ在住の魚売りで、バヤン・ムナ(左派政党)傘下のアナック・パウィスのメンバーと言われています。ゲラルド・ラバディアさんはセブ市トレス・デ・アブリル在住でバヤン・ムナ傘下の団体の労働オルグと言われています。2人は、2006年9月1日午後に、タリサ市バランガイ・タブノクのサウス・セントラル・マーケット近くで私服の氏名不詳の治安部隊員に逮捕されました。

 その日の午後3時頃、シャロン・アバンガさんは母に頼まれてもち米を買いにバランガイ・タブノクからサウス・セントラル・マーケットのあるタリサイ市に出かけました。目撃者によれば、シャロン・アバンガさんはマーケットの近くで逮捕される直前、ゲラルド・ラバディアさんと話をしていたということです。ゲラルド・ラバディアさんがタクシーに乗ってセブ市内の家に帰ろうとした時、私服の氏名不詳の治安部隊員が彼ら2人とタクシーの運転手を逮捕したということです。タクシーの運転手は後に釈放されました。

 拘禁された2人の行方は2006年9月4日まで分かりませんでした。9月4日に2人はグウェンドリン・ガルシア知事のもとに送られ、報道機関の前に引っぱり出されました。報道機関の前に姿を現すまで、シャロン・アバンガさんを必死で捜していた両親に対して、警察も軍も彼を拘禁していることを否定していました。警察と軍は、CPP-NPA(フィリピン共産党新人民軍)のメンバーである2人が、ビジネス関係者から現金とラップトップ・コンピューターをゆすり取ろうとしたという嫌疑をかけています。しかし、アバンガさんの地元の人々は、彼のことを前科のない魚売りだと考えています。サランカスのリーダーである有名なアルフレド・マホさんは、シャロン・アバンガさんはアナック・パウィスのメンバーとして活動していたが、2005年に結婚してからは活動をやめたと言っています。

 2006年9月4日に2人は反乱、恐喝、火器不法所持でタリサイ市の地方裁判所に起訴されました。同裁判所は、マーシャル・ルビア検察官を通じてセブ市の地方裁判所に事件を告発しました。保釈は認められていません。

<行動要請>

 フィリピン関係当局に以下の内容の要請をお願いします。

1.シャロン・アバンガさんとゲラルド・ラバディアさんの心身の安全を保障すること。

2.正当な嫌疑が不在の中、これら2人の即時釈放を保障すること。もしそのような嫌疑があるならば、2人を公正で資格のある裁判に付し、その間、彼らの司法手続き上の権利をすべて保障すること。

3.責任者すべてを特定し、彼らを裁判に付し、法に基づき民事、刑事あるいは行政処罰を適用するために、2人の恣意的拘禁について綿密で公正な調査を行うよう命じること。

4.国内法および国際人権基準に従って、国内全土における人権尊重と基本的自由を保障すること。

3) To order a thorough and impartial investigation into the arbitrary detention of the two detainees, in order to identify all those responsible, bring them to trial and apply to them the civil, penal and/or administrative sanctions provided by law;

4) To guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international human rights standards.

Arbitrary arrest and detention

Geneva, September 6, 2006

The International Secretariat of the World Organisation Against Torture (OMCT) requests your URGENT intervention in the following situation in the Philippines.

Brief description of the situation:

The International Secretariat of OMCT was informed by the Task Force Detainees of the Philippines (TDFP), a member of the OMCT network, of the arbitrary arrest and detention of Mr. Sharon Abangga (33) and Mr. Gerald Lavadia (35), at the South Central Market of Talisay City, Cebu on September 1, 2006, by the Criminal Investigation and Detection Group-7 (CIDG-7) under Supt. Jose Jorge Corpuz, based at Camp Sotero Cabahug in Cebu City and military intelligence based at Camp Lapu-lapu in Cebu.

According to the information received, Mr. Sharon Abangga, a fish vendor resident of Sitio Salvador Barangay Tangke, Talisay City, and an alleged member of Anak Pawis, a Bayan Muna affiliated organisation, and Mr. Gerald Lavadia, resident of Tres de Abril, Cebu City, allegedly a labor organiser of a Bayan Muna affiliated organisation, were arrested by unidentified security forces in civilian clothes near the South Central Market in Barangay Tabunok, Talisa City, during the afternoon of September 1, 2006.

It is reported that Mr. Sharon Abangga was sent by his mother to buy some sticky rice or ‘pilit’ around 3 pm in the afternoon of September 1, 2006 from Barangay Tabunok where the South Central Market of Talisay is. According to witnesses, Mr. Sharon Abangga was seen discussing with Mr. Gerald Lavadia, moments before their arrest nearby the market. When Mr. Gerald Lavadia was going to embark on a taxi to go back to his domicile in Cebu City, unidentified security forces in civilian clothing arrested Mr. Gerald Lavadia and Mr. Sharon Abangga along with the taxi driver who was later released.

The detainees were held incommunicado until September 4, 2006, when they were taken to the office of Gov. Gwendolyn Garcia and presented to the media. While both were in detention, and until the media presentation, the police and the military denied their custody to Mr. Sharon Abangga’s parents, who were actively looking for their son. The police and the military upheld alleged charges of both members of the CPP-NPA (the Communist Party of the Philippines - and its military arm the New People’s Army) who would have been entrusted with the task to extort revolutionary cash tax and laptops from businessmen, despite the views of the local residents of Mr. Abangga’s community for whom Mr. Sharon Abangga is a fish vendor with no criminal record. According to Mr. Alfred Majo, a well-known Salankas leader, Mr. Sharon Abangga was an active member of Anak Pawis, although he stopped these activities since he got married in 2005.


On September 4, 2006 both men were further charged with alleged cases of rebellion, robbery with intimidation, and illegal possession of firearms as cases were filed against them at the Regional Trial Court (RTC) in Talisay City, which in turn filed the complaints to the Regional Trial Court (RTC) in Cebu City through the Fiscal Marshal Rubia. No bail was recommended.

Action requested:

Please right to the authorities in the Philippines urging them to:

1. Guarantee the physical and psychological integrity of Mr. Sharon Abangga and Mr. Gerald Lavadia;

2. Ensure the immediate release of these two men in the absence of valid legal charges, and if such charges exist, bring them before an impartial and competent tribunal and guarantee their procedural rights at all times;

3. Order a thorough and impartial investigation into the arbitrary detention of the two detainees, in order to identify all those responsible, bring them to trial and apply to them the civil, penal and/or administrative sanctions provided by law;
