No.3923  アンゴラ:イギリスの人権活動家が釈放されて帰国を認められましたが、彼女に対する嫌疑はまだ取り下げられていません。

 「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、アンゴラにおける下記の状況に関して皆様の引き続きの働きかけをお願いします。

<新情報>

人権擁護家のための監視機構は信頼できる情報筋より、自然資源の搾取と紛争および人権を関係づけて活動している団体である「グローバル・ウィットネス」のキャンペーン担当上級職員である英国籍のサラ・ワイクスさんが、アンゴラ出国を許可されたという情報を得ました。

情報によれば、サラ・ワイクスさんは2007年3月15日、アンゴラを出国したいという彼女の請願は、司法が求めれば即時アンゴラに戻ってくることを条件に検事総長が受け入れたと知らされました。

彼女は2007年3月16日にアンゴラを出て、イギリスに帰国しました。

しかし、彼女に対する嫌疑はそのまま残っています。国家安全を脅かす犯罪に関するアンゴラ法の第26条の違反を含むこれら嫌疑は、書面ではなく、口頭でのみ彼女に告げられました。

国際監視機構は、サラ・ワイクスさんのために介入の行動をとってくださったすべての個人、組織、機関にお礼を申しあげます。同時に、それら嫌疑は彼女の人権活動に対する制裁が目的であり、それゆえ恣意的なために、それら嫌疑をすべて取り下げるよう求めます。

<背景情報>

2007年2月18日、ワイクスさんはカビンダで警察に逮捕されました。明け方4時、警察官が彼女が宿泊しているホテルの部屋に来て、パスポート、デジタルカメラ、ペン、ノートを含む所持品を多数押収しました。警察官は何も令状をもっていなかったため、ワイクスさんは彼らについていくことを拒みました。その結果、彼女は正式に逮捕され、警察署に連れていかれました。

その夜は監獄で過ごし、翌日2月19日に裁判所に連れていかれましたが、弁護士との面会は許されませんでした。

ワイクスさんはアンゴラに2007年2月11日に到着し、アンゴラでの原油歳入について透明化をはかる方法について市民グループや地方当局と会合を重ねていました。アンゴラ当局は彼女の入国を充分認識していましたし、事実、ビザも発行していました。

2007年2月21日、サラ・ワイクスさんは18万クワンザ(約2,000ドル)の保釈金で釈放されました。しかし、逮捕時に押収されたパスポートは返してもらっていません。

2月28日、彼女はカビンダを離れ、首都ルアンダに行ってよいという許可を得ましたが、2日に1度、ルアンダの警察署に出頭することが条件づけられていました。その時は、まだイギリスに帰国することは認められませんでした。

<行動要請>

アンゴラ関係当局に以下の内容の要請をお願いします。

1.ワイクスさんに対する嫌疑は恣意的なために、すべて取り下げること。

2.人権擁護家に対する嫌がらせの行為をすべて停止すること。

3.1998年12月9日に国連総会が採択した国連人権擁護家に関する宣言の条文、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条と、「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項を守ること。

4.国際人権基準とアンゴラが批准した国際人権条約にしたがい、いかなる情況にあろうとも、国内における人権尊重と基本的自由を保障うすること。

While I am welcoming issuing the permission to Ms. Wykes to return home in the UK, I remain concerned about the report that all charges on her have not yet dropped. I would like to urge you the following:

1. To drop all the charges brought against Ms. Wykes, as they are arbitrary;
2. To put an end to all acts of harassment against human rights defenders;
3. To conform with the provisions of the UN Declaration on Human Rights Defenders, adopted by the General Assembly of the United Nations on December 9, 1998, especially its article 1, which states that “everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels” and article 12.2, which states that “the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration”;
4. To ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights standards and international instruments ratified by Angola.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the International Federation for Human Rights (FIDH) and the World Organisation Against Torture (OMCT), has received new information and requests your urgent intervention in the following situation in Angola.

New information:
The Observatory has been informed by reliable sources that Ms. Sarah Wykes, a British citizen and a senior campaigner for Global Witness, an organisation working on the links between the exploitation of natural resources, conflicts and human rights, was granted the authorisation to leave Angola.

According to the information received, Ms. Sarah Wykes was officially notified on March 15, 2007 that her appeal to leave the country had been granted by the Attorney General on the condition that she returns to Angola upon request of the judicial authorities.

She travelled back to the United Kingdom on March 19, 2006.

However, the charges against her remain pending. These charges, including an alleged violation of Article 26 of the Angolan Law relating to crimes against national security, have only been notified to her orally.

The Observatory wishes to thank all the persons, organisations and institutions who intervened in favour of Ms. Wykes, but calls for the lift of all charges against her, as they aim at sanctioning her human rights activities and are therefore arbitrary.

Background information:

On February 18, 2007, Ms. Wykes was arrested by the police in Cabinda. At 4 am, police officers came to her hotel room, and seized a number of her personal belongings, including her passport, a digital camera, two pen drives and a notebook. As the policemen did not have any warrant, Ms. Wykes refused to follow them. As a result, she was formally arrested and brought to the police station.

She then spent the night in jail and was brought to court on February 19, 2007, without being allowed to meet her lawyer.

Ms. Wykes had arrived in Angola on February 11, 2006 to meet with civil society and local authorities to discuss the process of transparency in oil revenues in Angola. The Angolan authorities were fully aware of the visit of Ms. Wykes and had granted her a visa.

On February 21, 2007, Ms. Sarah Wykes was released on a bail of 180,000 kwanzas (approx. $US 2,000). However, her passport, which was confiscated when she was arrested, had not been returned to her.

On February 28, 2007, she was given permission to leave Cabinda and to return to the capital Luanda, on condition that she would report to the police every two days. She had not been authorised to travel back to the United Kingdom.

Action requested:
Please write to the Angolan authorities urging them to:

i. Drop all the charges brought against Ms. Wykes, as they are arbitrary;

ii. Put an end to all acts of harassment against human rights defenders;

iii.
