No.3930 サウジアラビア:弁護士、医師などの人権擁護家10人の拘禁が続いています

 「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、サウジアラビアにおける下記の状況に関して皆様の引き続きの働きかけをお願いします。

<新情報>

 人権擁護家のための監視機構は信頼できる情報筋より、サウジアラビアにおいて10人の人権擁護家の隔離拘禁が続いているという情報を入手しました。

 入手した情報によると、2007年3月23日の時点で以下の人々がジェッダ市内の総合情報局の施設で隔離拘禁され続けているということです。弁護士のスレイマン・アル・ラシュディさんとエッサム・アル・バスラウィさん、医師のサウド・アル・ハシミさん、大学教授のムサ・アル・キルニさんとアブデル・ラフマン・アル・シュマイリさん、職業不詳のアブデルアジズ・アル・カリジさんとアル・シャリフ・サイフ・アル・ガリブさん。

 しかも、弁護団や家族が何度も要望しているにもかかわらず、彼らとの面会が認められていないということです。

 この人々は全員平和的な人権活動で有名でした。とくに過去にはサウジアラビア王国の政治的および民主的改革と人権尊重をアブドラ・ビン・アブドルアジズ・アル・サウド国王に訴える陳情書への署名活動に関わっていました。

 この人々は「違法に資金を集め、国外の疑わしい組織に渡していた」という疑いをかけられているということですが、正式には起訴されていません。

 また重要な点は、彼らの弁護団の一人であるバセム・アラムさんがこの件への関わりを理由に嫌がらせを受けていることです。彼は3週間前に当局によって海外渡航を妨害されました。

 監視機構はこの10人の隔離拘禁は彼らの人権活動に対する制裁がねらいであると考え、彼らの心身の安全を憂慮します。

<背景情報>

 2007年2月3日、スレイマン・アル・ラシュディさん、エッサム・アル・バスラウィさん、ムサ・アル・キルニさん、アブデル・ラフマン・アル・シュマイリさん、アブデルアジズ・アル・カリジさん、アル・シャリフ・サイフ・アル・ガリブさんが逮捕され、隔離拘禁されました。

 そのうち何人かはメディナ市で逮捕され、他の人々は国の政治的民主的改革のための平和的な活動について話し合っていたジェッダ市内のバフラという住宅街で総合情報局職員に逮捕されました。同じ職員らがエッサム・アル・バスラウィさんの自宅を強制捜査し、彼と家族の本数冊とコンピューターを押収しました。その上、家財道具の一部を壊しました。

 2007年2月5日、エッサム・バスラウィさんの息子は父親との面会を認められず、二度と父親に会いにきてはならないと、当局より帰宅を命じられました。バスラウィさんは病気で障害をもっているため、息子は医薬品を渡そうとしていました。

<行動要請>

 サウジアラビア関係当局に以下の内容の要請をお願いします。

1. いかなる情況にあろうとも、スレイマン・アル・ラシュディさん、エッサム・アル・バスラウィさん、ムサ・アル・キルニさん、アブデル・ラフマン・アル・シュマイリさん、アブデルアジズ・アル・カリジさん、アル・シャリフ・サイフ・アル・ガリブさんの心身の安全を保障すること。

2. 彼らに弁護士との接見および家族との面会の権利を保障すること。

             

3.彼らの拘禁は恣意的なため、全員を即時無条件で釈放すること。

4. 彼ら全員、彼らの弁護士バセム・アラムさん、そしてサウジアラビアのすべての人権擁護家に対するあらゆる形態の嫌がらせ行為を止めること。

5. 1998年12月9日国連総会が採択した人権擁護家に関する宣言の条文、とりわけ、「すべての者は、個々にまた他の者と共同して、国内、国際レベルにおいて人権および基本的自由の保護ならびに実現を伸長、奨励する権利を有する」とした第1条と、「国家は、この宣言に掲げられた権利を正当に行使した結果としてのあらゆる暴力、脅迫、報復、事実上のあるいは法律上の敵意に満ちた差別、圧力、あるいはその他のあらゆる恣意的な行為に反対し、すべての者を、個々にまたは他の者と共同して、権限ある当局によって確実に保護するための、すべての必要な措置をとるべきである」とした第12.2条に従うこと。

6.サウジアラビアが批准した国際人権文書に沿って、国内における人権尊重と基本的自由を保障すること。

Dear King Abdoullah,

I am writing you to express my concern over the detention of Messrs. Sulieman al-Rushudi, Saud al-Hashimi, Essam al-Basrawi, Al-Sharif Saif Al-Ghalib, Musa al-Qirni, Abdel Rahman al-Shumayri, and Abdelaziz al-Khariji who have been detained in the office of General Intelligence Service since February 3, 2007. As their arrest and detention is arbitrary, I would like to urge you he followings:

1. To guarantee, in all circumstances, the psychological and physical integrity of Messrs.
Sulieman al-Rushudi, Saud al-Hashimi, Essam al-Basrawi, Al-Sharif Saif Al-Ghalib, Musa al-Qirni, Abdel Rahman al-Shumayri, Abdelaziz al-Khariji and all persons detained;
2. To guarantee their right to receive visit and communicate with their lawyers and relatives;
3. To release them immediately and unconditionally since their detention is arbitrary;
4. To put an end to all acts of harassment against the ten above-mentioned men, as well as their lawyer, Mr. Basem Alam, and all other human rights defenders in Saudi Arabia;
5. To conform with the provisions of the UN Declaration on Human Rights Defenders, adopted by the General Assembly of the United Nations on December 9, 1998, especially its article 1, which states that “everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels” and article 12.2, which states that “the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present
Declaration”;
6. To ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights standards ratified by Saudi Arabia.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), has received new information and requests your urgent intervention in the following situation in Saudi Arabia.

Brief description of the situation:

The Observatory has been informed by reliable sources about the ongoing incommunicado detention of ten human rights defenders in Saudi Arabia.

According to the information received, as of March 23, 2007, Messrs. Sulaiman al-Rashudi and Essam al-Basrawi, lawyers, Mr. Saud al-Hashimi, a doctor, Messrs. Musa al-Qirni and Abdel Rahman al-Shumayri, university professors, and Messrs. Abdelaziz al-Khariji and Al-Sharif Saif Al-Ghalib, whose profession remain unknown, were remaining in incommunicado detention in the offices of the General Intelligence Service (al-Mabahith al-‘Amma) in Jeddah.

Moreover, since their arrest, neither their lawyers nor their relatives were granted access to the detainees, despite their repeated requests.

All men are known for their peaceful human rights activities. In particular, they engaged in the past in signing petitions addressed to King Abdullah Bin Abdulaziz Al-Saud calling upon him to initiate for political and democratic reforms in the Kingdom and the respect human rights.

Although the men are reportedly suspected of “illegally collecting money and funnelling funds to suspicious elements outside the country”, no official charge was brought against them.

It is important to outline that Mr. Basem Alam, one of their lawyers, is also subjected to acts of harassment due to his involvement in this case. For instance, he was prevented from leaving the country by the authorities about three weeks ago.

The Observatory expresses its deep concern about the ongoing incommunicado detention of these ten men, which appears to be solely aimed at sanctioning their human rights activities, and fears for their physical and psychological integrity.

Background information:

On February 3, 2007, at 3 am, Messrs. Sulaiman al-Rashudi, Essam al-Basrawi, Saud al-Hashimi, Messrs. Musa al-Qirni and Abdel Rahman al-Shumayri, and Messrs. Abdelaziz al-Khariji and Al-Sharif Saif Al-Ghalib were arrested and placed in incommunicado detention.

While some were arrested in Madinah city, others were arrested by officials of the General Intelligence Service in a residential area called “Bahra”, in Jeddah city, were they had met to discuss the organisation of peaceful activities in favour of political and democratic reforms in the Kingdom. The same officials also raided the house of Mr. Essam al-Basrawi and confiscated several books and computer units belonging to him and his family. The officials would also have destroyed some furniture and some personal belongings of the family.

On February 5, 2007, Mr. Essam Basrawi’s son was denied the right to visit his father, ordered to return home and warned to never ask again to meet his father. He wanted to hand him some medicine, as Mr. Essam Basrawi is ill and disabled.

Action requested:

Please write to the authorities of the Kingdom of Saudi Arabia urging them to:

i. Guarantee, in all circumstances, the psychological and physical integrity of Messrs. Sulieman al-Rushudi, Saud al-Hashimi, Essam al-Basrawi, Al-Sharif Saif Al-Ghalib, Musa al-Qirni, Abdel Rahman al-Shumayri, Abdelaziz al-Khariji and all persons detained;

ii. Guarantee their right to receive visit and communicate with their lawyers and relatives;

iii. Release them immediately and unconditionally since their detention is arbitrary;

iv. Put an end to all acts of harassment against the ten above-mentioned men, as well as their lawyer, Mr. Basem Alam, and all other human rights defenders in Saudi Arabia;

v.
