No.3934 イラク:組合活動家がテロリスト集団と思われる一団に誘拐され殺害されました。

 「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、イラクにおける下記の状況に関して皆様の緊急の働きかけをお願いします。

<事件の概要>

人権擁護家のための監視機構は、国際労働組合総連合(ITUC)より、バグダッド機械・印刷・金属労働組合事務局長を2003年より務め、またイラク労働組合総連合会(GFIW)の設立者で指導者のナジム・アブド・ジャセムさんが誘拐され、殺害されたという情報を入手しました。

入手した情報によると、ナジム・アブド・ジャセムさんは2007年3月27日にバグダッドで誘拐されました。拷問の跡が明白に残る彼の遺体が、3日後の3月30日に見つかりました。

ナジム・アブド・ジャセムさんは強い信念をもった組合指導者で、フセイン政権時代に政府の公式な組合に反対したため、職を解雇されたことがあります。

監視機構は、2006年1月25日に機械労働組合のバグダッド支部執行理事でGFIWの著名なメンバーであったアラー・イッサ・カラフさんがバグダッドの自宅から仕事に行こうとしたところを数人の正体不明の男たちに撃たれて死亡したことを想起します。同様に、イラク保健医療総連合会理事のタベット・フセイン・アリさんも、2006年4月7日にバグダッドのアル・マンスール地区にある組合本部を出た時にテロリスト集団と思われる一団に誘拐されました。翌日、体中を撃たれ、拷問の跡がある彼の遺体が見つかりました。(監視機構の2006年次報告参照)

監視機構はいまだにフセイン時代の反組合法が残る中で活動している労働組合活動家の殺害が増えているという状況を憂慮し、イラク当局に対し、迅速に国際労働機関(ILO)の「結社の自由及び団結権保護条約(第87号)」を批准するよう要請します。

全般的に、監視機構はイラクの人権擁護家の状況に対して深い憂慮を表明します。イラクの人権擁護家は自分の暮らしと身の安全を危険にさらしており、非常に危険な状態の中で人権活動を行っています。

<行動要請>

 イラク関係当局に以下の内容の要請をお願いいたします。

1.いかなる情況にあろうとも、労働組合活動家を含むイラクの人権擁護活動家の心身の安全を保障すること。

2.実行者を特定し、裁判に付し、罪の重さに応じた量刑を言い渡すことができるよう、ナジム・アブド・ジャセムさん暗殺について、公正、中立そして独立した調査を実施すること。

3.被害者の家族に適切な補償が届くように保障すること。

4.イラクの人権擁護家に対するあらゆる形態の嫌がらせと虐待を中止し、いかなる情況にあろうとも人権擁護家と人権組織が妨害なく活動を遂行できるように保障すること。

5.1998年12月9日に国連総会が採択した人権擁護家に関する宣言の条文、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条と、「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項の実施を保障すること。

6.世界人権宣言およびイラクが批准した国際文書に従い、国内全土における人権尊重と基本的自由を保障すること。

I would like to express my concern over the abduction and killing of the unionist Mr. Najim Abd-Jasem on March 27 and 30, 2007 respectively. I would like to urge you the followings:

1. To guarantee the physical and psychological integrity of all human rights defenders working in Iraq, including trade unionists, in all circumstances;
2. To conduct a fair, impartial and independent inquiry into the assassinations of Mr. Najim Abd-Jasem, in order to identify the authors, bring them to justice and pronounce sentences proportional to the gravity of their crimes;
3. To guarantee that adequate reparation is provided to the victim's family;
4. To end all forms of harassment and ill-treatment of human rights defenders in Iraq, and guarantee in all circumstances that human rights defenders and organisations are able to carry out their work without any hindrance;
5. To ensure the implementation of the provisions of the Declaration on Human Rights Defenders adopted by the UN General Assembly on December 9, 1998, in particular article 1, which states that “everyone has the right, individually or in association with others, to promote and to strive for the protection and realization of human rights and fundamental freedoms at the national and international levels”, as well as article 12.2, which provides that “the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually or in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration”;
6. To guarantee the respect of human rights and fundamental freedoms in accordance with the Universal Declaration on Human Rights and other international human rights instruments ratified by Iraq.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), requests your urgent intervention in the following situation in Iraq.

Description of the situation:

The Observatory has been informed by the International Trade Union Confederation (ITUC) of the abduction and subsequent murder of Mr. Najim Abd-Jasem, General Secretary of the Mechanics, Printers and Metalworkers Union in Baghdad since 2003 and a founder as well as a leader of the General Federation of Iraqi Workers (GFIW).

According to the information received, on March 27, 2007, Mr. Najim Abd-Jasem, was abducted in Baghdad. His body, showing clear signs of torture, was found three days later, on March 30, 2007.

A very principled trade union leader, Mr. Najim Abd-Jasem was fired from his job during Saddam Hussein’s regime for having opposed the government’s official union.

The Observatory recalls that on January 25, 2006, Mr. Alaa Issa Khalaf, a member of the Executive Board of the Baghdad branch of the Mechanics Union, and a prominent member of the GFIW, was shot dead by several unidentified men as he left for work from his home in Baghdad. Likewise, Mr. Thabet Hussein Ali, director of the General Trade Union for Health Sector Workers in Iraq, was abducted on April 7, 2006 by a presumed terrorist group as he was leaving his union’s headquarters in Baghdad Al-Mansour neighbourhood. His body was found the following day, riddled with gunshot wounds and bearing marks of torture (See Observatory 2006 Annual Report).

The Observatory is very concerned that murder of labour leaders in Iraq has become a troubling trend in a country where trade unionists still operate under anti-union legislation which dates back to the Saddam-era, and urges the Iraqi authorities to immediately ratify the Convention 87 on freedom of association of the International Labour Organisation (ILO).

More generally, the Observatory expresses its deepest concern at the situation of human rights defenders in Iraq, who face tremendous risk to their lives and security, and who are therefore conducting their activities in an extremely precarious situation.

Actions requested:

Please write to the Iraqi authorities urging them to:
i. guarantee the physical and psychological integrity of all human rights defenders working in Iraq, including trade unionists, in all circumstances;

ii. conduct a fair, impartial and independent inquiry into the assassinations of Mr. Najim Abd-Jasem, in order to identify the authors, bring them to justice and pronounce sentences proportional to the gravity of their crimes;

iii. guarantee that adequate reparation is provided to the victim’s family;

iv. end all forms of harassment and ill-treatment of human rights defenders in Iraq, and guarantee in all circumstances that human rights defenders and organisations are able to carry out their work without any hindrance;
