No.3961 カンボジア:違法な森林伐採に関する報道を行ったジャーナリストが当局より殺しの脅迫を受けています。

(ジュネーブ・パリ発 6月22日)

「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、カンボジアにおける下記の状況に関して皆様の緊急の働きかけをお願いします。

<事件の概要>

人権擁護家保護のための監視機構は、カンボジア人権発展協会(ADHOC)からコンポン・トム地方の森林破壊について報道した後、自由アジアラジオの記者、レム・ピセスさんが何者かから殺害の脅しを受けているという情報を入手しました。

入手した情報によると、2007年6月16日、レム・ピセスさんはカンボジア南部のカンポン・セウに向かう途中、携帯電話に匿名の電話を受けました。電話をかけてきた男はピセスさんを「無礼なやつ」と呼び、死にたいかどうかを尋ねました。その男はピセスさんが行った「森林に関する話」のために、このような言動に出ていると説明し、ピセスさんを埋めるような土地はないと言いました。ピセスさんは、表示された電話番号にかけなおしましたが、コールセンターにしかつながりませんでした。

この脅しは、ピセスさんがコンポン・トム地方の森林破壊に関する記事を4本書いた後に行われたものです。記事を書いた後に、ピセスさんは警察や軍隊に尾行されましたし、何の説明もないまま滞在中のホテルから出て行くようホテルのオーナーから言われました。

これら出来事は、2007年6月1日にNGOのグローバル・ウィットネスがカンボジアにおける違法森林伐採に関する報告を出した後に起きています。2007年6月3日、カンボジア当局はこの報告書を発禁処分にしました。さらに、情報大臣のキエウ・カンハリスさんは、新聞各社に対して、この報告書について言及してもよいが、内容を掲載してはならないと忠告しました。しかし、自由アジアラジオを含むいくつかのメディアは、2007年6月8日以降もその報告書に関するニュースを出し、この問題に関して報道を止めるよう警察から命令されました。レム・ピセスさんもラジオ放送でこの報告書についてとりあげました。

こうした脅しの結果、レム・ピセスさんは、海外に逃亡せざるをえなくなりました。

監視機構は、カンボジアにおける表現の自由に対する制限と、人権擁護者、市民社会一般およびレム・ピセスさんに対する脅しに関して深い懸念を表明します。

<行動要請>

カンボジア関係当局に以下の内容の要請をお願いします。

1.いかなる状況にあろうとも、レム・ピセスさんの心身の安全を保障すること。

2.レム・ピセスさんおよび国内の人権擁護家に対するあらゆる種類の嫌がらせおよび脅しを止めること。

3.1998年12月9日に国連総会が採択した人権擁護家に関する宣言の条文、特に、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条と、「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項に従うこと。

4.国際人権基準およびカンボジアが批准した国際文書に従い、いかなる状況にあろうとも、人権尊重と基本的自由を保障すること。

Dear Prime Minister Hun Sen,

I am writing you to express my concern over the situation of Mr. Lem Piseth, a journalist at Radio Free Asia, who has been threatened by the police for his journalist activities in regard to the report on illegal forest destruction in Cambodia. I would like to urge you the following.

1. To guarantee in all circumstances the physical and psychological integrity of Mr. Lem Piseth;
2. To put an end to any kind of act of harassment and threats against Mr. Lem Piseth as well as against all human rights defenders in the country;
3. To conform with the provisions of the UN Declaration on Human Rights Defenders, adopted by the General Assembly of the United Nations on December 9, 1998, especially its article 1, which states that “everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels”, and article 12.2, which states that “the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration”;
4. To ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights standards and international instruments ratified by Cambodia.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the International Federation for Human Rights (FIDH) and the World Organisation Against Torture (OMCT), requests your urgent intervention in the following situation in Cambodia:
Brief description of the situation:

The Observatory has been informed by the Cambodian Human Rights and Development Association (ADHOC) about the anonymous death threats made against Mr. Lem Piseth, a journalist at Radio Free Asia, after he reported on deforestation in Kompong Thom province.

According to the information received, on June 16, 2007, Mr. Lem Piseth was on his way to Kampong Seu, in southern Cambodia, when he received an anonymous call on his cell phone. A man’s voice called him “insolent” and asked him if he “wanted to die”. The man explained that he was insulting the reporter “because of the story about the forest”, and that there would not be “enough land to bury [him] in”. Mr. Piseth tried to call the number back, but could only reach a call centre.

These threats follow the publication by Mr. Piseth of four articles on the damage resulting from forest destructions in Kompong Thom province. Following the publication of these articles, Mr. Piseth was also followed by the police and the military, and asked to leave the hotel room he was staying in by the owners, without any explanation.

It is worth mentioning that these events take place after the publication of a report on illegal forest destruction in Cambodia, on June 1, 2007, by the NGO Global Witness. On June 3, 2007, this report was banned by the Cambodian authorities and on June 8, 2007, the Cambodian Ministry of Information Mr. Khieu Kanharith further declared that “newspapers [could] refer to [the report] but not reproduce it” (See Urgent Appeal of the Observatory KHM 002/0607/OBS 064, issued on June 7, 2007)”. Yet, Radio Free Asia, like several other media, continued to release news about the report after June 8, 2007, and was ordered to cease any radio broadcasting on this issue by a police official. Mr. Lem Piseth also quoted the report in a radio broadcast.

As a consequence of the threats received, Mr. Lem Piseth was obliged to flee abroad.

The Observatory expresses its deep concern about these threats against Mr. Lem Piseth, as well as against human rights defenders and civil society in general, as well as the restrictions on their work and the exercise of freedom of expression in Cambodia.

Actions required:

Please write to the authorities of Cambodia urging them to:

i. Guarantee in all circumstances the physical and psychological integrity of Mr. Lem Piseth;

ii. Put an end to any kind of act of harassment and threats against Mr. Lem Piseth as well as against all human rights defenders in the country;

iii.
