No.3983 エジプト:人権NGOが社会連帯省より閉鎖命令をうけました。

 「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、エジプトにおける以下の状況に関して、皆様の緊急の働きかけをお願いします。

<事件の概要>

人権擁護家のための監視機構は「アラブ人権活動家プログラム(APHRA)」より、カイロで警察の拷問を監視・告発し、拷問被害者に法的支援を提供しているNGO「人権・法律支援協会(AHRLA)」の閉鎖が決定されたという情報を入手しました。

情報によると、AHRLA は2007年9月8日に社会連帯省より財政面での違反を理由とした閉鎖命令を受けました。同省は、法律第84号(2002年制定)の第17条(2)「社会連帯省の承認を得ない限り、いかなるNGOも海外から、それがエジプト人であれ、外国人であれ、団体であれ、またはエジプトにおかれたその代表部であれ、金銭を受け取ったり、海外の個人や団体に送金してはならない。書籍、ニュースレター、科学もしくは芸術に関する定期刊行物は例外とする」を命令の根拠としています。

実際は、AHRLA は社会連帯省に海外から助成金を受ける許可を求め続けてきましたが、それを認めず、許可はでされていません。このように人権団体に持続可能な活動をさせないようにすることで同省は国際的および地域的人権基準に違反しています。

監視機構は、エジプトにおける結社の自由に対するこのあらたな違反に懸念を表明し、「労働組合・労働者サービスセンター(CTUWS)」の複数の支部が2007年3月と4月に閉鎖されたことを指摘します。(2007年4月17日と23日にそれぞれ出されたアピールEGY001/0407/OBS035と035.1参照。)監視機構は、結社の自由に関する国際的および地域的人権基準、とくに1998年 12月9日に国連総会が採択した人権擁護家に関する宣言の第13条「本宣言第3条に従い、すべての者は、個々にまた他の者と共同して、平和的な手段を通じて人権および基本的自由の伸長と保護を表明する目的のために、資料を収集し、利用する権利を有する」とエジプトの法律を合致させるよう、エジプト当局に要請します。

<行動要請>

 エジプト関係当局に以下の内容の要請をお願いします。

1.人権・法律支援協会に対するあらゆる形態の嫌がらせを止め、閉鎖の決定を撤回し、同協会のメンバーが自由に活動できるように保障すること。

2.エジプトの人権擁護家に対するあらゆる形態の嫌がらせを止めること。

3.国連人権擁護家に関する宣言の条文、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条、「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項、そして「本宣言第3条に従い、すべての者は、個々にまた他の者と共同して、平和的な手段を通じて人権および基本的自由の伸長と保護を表明する目的のために、資料を収集し、利用する権利を有する」とした第13条に従うこと。

4.エジプトにおける結社の自由を促進して保障し、いかなる情況にあろうとも国際人権基準およびエジプトが批准した国際文書にそって、国内全土における人権の尊重と基本的自由を保障すること。

1. To put an end to all forms of harassment against the Association for Human Rights Legal Aid, repeal the decision to close it down and ensure in all circumstances that its members are able to carry out their work freely without any hindrances;
2. To put an end to all forms of harassment against human rights defenders in Egypt;
3. To conform with the provisions of the UN Declaration on Human Rights Defenders, in particular its Article 1, which provides that "everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels", above-mentioned Article 11 as well as Article 12(1) that provides "everyone has the rights, individually and in association with others, to participate in peaceful activities against violations of human rights and fundamental freedoms", and its Article 13 above-mentioned;
4. To promote and ensure freedom of association in Egypt and ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights standards and international instruments ratified by Egypt.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), expresses its deepest concern regarding the following situation in Egypt.

Brief description of the situation:

The Observatory has been informed by the Arab Program for Human Rights Activists (APHRA) about the decision to close down in Cairo the Association for Human Rights and Legal Aid (AHRLA), a non-governmental organisation monitoring and denouncing acts of torture in police stations as well as providing legal support to victims of torture.

According to the information received, on September 8, 2007, the Association for Human Rights Legal Aid was notified of a closing-down order issued by the Ministry of Social Solidarity, alleging financial transgressions. The Ministry based its order on Article 17(2) of Law n° 84 (2002), which states that "in all cases no NGO is permitted to receive money from abroad whether from Egyptian or foreign persons or agencies or their representatives in Egypt, or sending money to persons or organisations abroad unless they obtain the permission of the Minister of Social Solidarity, except for books, newsletters and scientific and artistic journals".

In reality, even though the Association for Human Rights Legal Aid has always asked the Ministry for authorisation to receive grants from abroad, the Ministry has always refused to give its permission for long periods, therefore hindering human rights organisations from carrying out longstanding and sustainable activities, and thus violating international and regional human rights standards.

The Observatory expresses its deep concern about this new infringement to freedom of association in Egypt, and recalls that several branches of the Centre for Trade Union and Workers Services (CTUWS) were shut down in March and April 2007 (See Urgent Appeals EGY 001/0407/OBS 035 and 035.1, respectively issued on April 17 and 23, 2007). The Observatory therefore calls upon the Egyptian authorities to put their legislation in conformity with international and regional human rights standards concerning freedom of association, in particular with Article 13 of the Declaration on Human Rights Defenders adopted by the UN General Assembly on December 9, 1998, which states that "everyone has the right, individually and in association with others, to solicit, receive and utilize resources for the express purpose of promoting and protecting human rights and fundamental freedoms through peaceful means, in accordance with article 3 of the present Declaration".

Action requested:

Please write to the Egyptian authorities and ask them to:

iii. Put an end to all forms of harassment against the Association for Human Rights Legal Aid, repeal the decision to close it down and ensure in all circumstances that its members are able to carry out their work freely without any hindrances;

iv. Put an end to all forms of harassment against human rights defenders in Egypt;

v.
