No.3997 フィリピン:労働運動活動家が根拠のないまま「反乱」の罪状で恣意的に起訴されました。

 「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、フィリピンにおける以下の状況に関して、皆様の緊急の働きかけをお願いします。

<事件の概要>

人権擁護家のための監視機構はフィリピン被拘禁者救援委員会(TFDP)より、労働者の権利のために活動している「5月1日運動(KMU)」の運動家であり、セブ州ダラグエテ町カサイ集落の全国労働連合支部のメンバーでもあるリカルド・ベラミア・イ・ベセリルさんが恣意的に拘禁されているという情報を入手しました。

情報によると、2007年11月2日午後2時頃、ベラミアさんはフィリピン国家警察地方部とフィリピン中央司令部軍(CENTCOM)に自宅で逮捕されました。この逮捕は、ダナオ市第25地方裁判所(RTC)のシルビア・アギレ・デランガ裁判官が2006年3月21日付で出した逮捕状を根拠としたものでした。

2007年11月5日、ベラミアさんは法廷に出席させられ、ダナオ市第25地方裁判所に「反乱」の罪状で起訴されました。彼は新人民軍(NPA)の幹部として、2004年にセブ州のタブエラン町ダリド集落、ツブランのスモン集落とカランガマン集落、ダナオ市のバリアン集落で起きたという軍と反政府軍の衝突での陸軍歩兵第78大隊の兵士の殺害に関与したと疑われています。しかし、ベラミアさんは自分はNPAメンバーではないとずっと主張しています。

 このアピール発表時点でベラミアさんはセブ市ラフグのアパスにあるフィリピン中央司令部軍のラプラプ駐屯地で拘禁されています。

監視機構は、リカルド・ベラミア・イ・ベセリルさんの恣意的な拘禁は彼の人権活動に制裁を与える狙いとしか考えられないため、これに憂慮を表明します。

監視機構は、フィリピン国内のすべての人権擁護家に対するあらゆる嫌がらせをやめ、1998年 12月9日に国連総会が採択した人権擁護家に関する宣言、とくに第12条2項「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」を遵守するよう、フィリピン当局に要請します。

<行動要請>

 フィリピン関係当局に以下の内容の要請をしてください。

1.いかなる情況にあろうともリカルド・ベラミア・イ・ベセリルさんの心身の安全を保障すること。

2.リカルド・ベラミア・イ・ベセリルさんの拘禁は彼の人権活動に対する制裁であり、恣意的であるため、彼を即時無条件で釈放すること。

3.フィリピンの人権活動家に対するあらゆる形態の嫌がらせと虐待を止め、いかなる情況にあろうとも彼・彼女たちがその活動を支障なく遂行できるよう保障すること。

4.1998年12月9日に国連総会が採択した国連人権擁護家に関する宣言の条文、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条と、「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項を守ること。

5.さらには、いかなる情況にあろうとも、国際人権基準とフィリピンが批准した国際文書に従って、国内全土における人権尊重と基本的自由を保障すること。

2. To release Mr. Ricardo Bellamia y Beceril immediately and unconditionally since his detention is arbitrary as it merely aims at sanctioning her human rights activities;
3. To end all forms of harassment and ill-treatment of human rights defenders in the Philippines, and guarantee in all circumstances that they be able to carry out their work without any hindrance;
4. To conform with all the provisions of the UN Declaration on Human Rights Defenders, especially its Article 1, which states that "everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels" and above-mentioned Article 12.2;
5. More generally, to ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights standards and international instruments ratified by the Philippines.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), requests your urgent intervention in the Philippines.

Brief description of the situation:

The Observatory has been informed by Task Force Detainees of the Philippines (TFDP) of the arbitrary detention of Mr. Ricardo Bellamia y Beceril, an organiser of labour unions for Kilusang Mayo Uno - Labour Centre (KMU), an organisation struggling in favour of workers' rights, and a member of the National Federation of Labour in Barangay Casay in Dalaguete town, province of Cebu.

According to the information received, on November 2, 2007, at about 2 pm, Mr. Bellamia was arrested at home by members of both the Regional Command of the Philippine National Police (PNP) and of the Armed Forces of the Philippines Central Command (CENTCOM), on the basis of a warrant of arrest issued by the Judge Sylvia Aguirre Delanga of the Regional Trial Court (RTC), Branch 25, Danao City, dated March 21, 2006.

On November 5, 2007, Mr. Bellamia was brought to Court and charged with "rebellion" by the Regional Trial Court, Branch 25, Danao City. He would be accused of being an official of the New People's Army (NPA) and of being linked to the killing of soldiers belonging to the 78th Infantry Battalion during rebel-military encounters that occurred reportedly in 2004 at Brgy Dalid, Tabuelan town, Brgy Sumon and Brgy Kalanggaman in Tuburan, and Brgy Baliang in Danao City, all in the province of Cebu. Yet, Mr. Bellamia has always denied being a NPA member.

As of issuing this urgent appeal, Mr. Bellamia would be detained at the Central Command of the Armed Forces of the Philippines at Camp Lapu-lapu in Apas, Lahug, Cebu City.

The Observatory expresses its deep concern about the arbitrary detention of Mr. Ricardo Bellamia y Beceril as it seems to merely aim at sanctioning his human rights activities.

The Observatory further urges the Philippines authorities to put an end to any kind of harassment against all human rights defenders in the country, as well as to conform with the United Nations Declaration on Human Rights Defenders adopted by the UN General Assembly on December 9, 1998, especially its Article 12.2, which states that "the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration".

Action requested:

Please write to the Philippine authorities asking them to:

i. Guarantee in all circumstances the physical and psychological integrity of Mr. Ricardo Bellamia y Beceril;
ii. Release Mr. Ricardo Bellamia y Beceril immediately and unconditionally since his detention is arbitrary as it merely aims at sanctioning her human rights activities;
iii. End all forms of harassment and ill-treatment of human rights defenders in the Philippines, and guarantee in all circumstances that they be able to carry out their work without any hindrance;
iv. Conform with all the provisions of the UN Declaration on Human Rights Defenders, especially its Article 1, which states that "everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels" and above-mentioned Article 12.2;
v. More generally, ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights standards and international instruments ratified by the Philippines.
