No.3999 中国:解雇に反対する労働者の代表が労働再教育キャンプに恣意的に拘禁されました。

 「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、中国における以下の状況に関して、皆様の緊急の働きかけをお願いします。

<事件の概要>

人権擁護家のための監視機構は「中国人権擁護家」(CRD)より、ゾンギュアン油田からレイオフされた労働者の代表であるリー・グオホンさんが、ゾンギュアン油田公安局(PSB)によって労働再教育(RTL)キャンプに1年半入れられることになったという情報を入手しました。

情報によると、リー・グオホンさんは解雇された労働者がゾンギュアン油田に対して北京で起こそうとしている訴訟について知るため、2007年10月31日に同油田の本社がある河南省プヤン市に行ったということです。リーさんは、前に拘禁されたゾンギュアン油田の労働者について情報を得るため、ゾンギュアン油田公安局に行きました。彼が公安局に着くとすぐに15日間行政拘禁されました。彼は2007年11月16日に釈放される予定でしたが、当局は逆に彼を労働再教育キャンプに送りました。このアピール発表時点では、彼がどのような理由で拘禁されたのかは判明していません。

中国石油化学会社(Sinopec)の子会社であるゾンギュアン油田は、2001年以降、1万人の従業員を適切な補償をせずに解雇しています。昨年、解雇された労働者の代表が上級の当局に陳情を行いましたが、そのために暴行を受けたり、拘禁されたりしました。リーさんはこの代表者の一人です。

労働再教育(RTL)は行政拘禁措置であり、公安局が適切な司法手続きや裁判なしで人々を最長4年間拘禁施設に入れることができるものです。RTLに送られた被拘禁者は弁護士をつけたり、控訴する権利を奪われます。

監視機構は、リー・グオホンさんの恣意的拘禁を憂慮し、適正手続きや自由で公平な裁判、弁護士をつける権利を彼に認めないことは、中国が署名はしたものの批准していない「市民的及び政治的権利に関する国際規約(ICCPR)」(第9条)および世界人権宣言(第9条〜第11条)の重大な違反であると指摘します。また彼の拘禁は1998年 12月9日に国連総会が採択した人権擁護家に関する宣言、とくに第12条2項「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」にも大きく違反しています。

監視機構は、ここ数年、拷問や虐待を受ける人権擁護家が増えていることから、リー・グオホンさんの心身の安全を危惧します。

<行動要請>

 中国関係当局に以下の内容の要請をお願いします。

1.いかなる情況にあろうともリー・グオホンさんの心身の安全を保障すること。

2.彼の拘禁は彼の人権活動に対する制裁としか思えないので、彼の即時釈放を保障すること。

3.中華人民共和国のすべての人権擁護家に対する嫌がらせを止めること。

4.1998年12月9日に国連総会が採択した国連人権擁護家に関する宣言の条文、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条と、国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条に従うこと。

5.いかなる情況にあろうとも、国際基準および中国が批准した国際文書に従って、人権尊重と基本的自由を保障すること。

I am writing you to express my concern over the detention of Mr. Li Guohong, a laid-off workers' representative at Zhongyuan Oil Field, at the Re-education Through Labour (RTL). As his detention seems to be a sanction of his human rights activities, I would like to urge you the followings.

1. To guarantee in all circumstances the physical and psychological integrity of Mr. Li Guohong;
2. To ensure his immediate release since his detention is arbitrary as it merely aims at sanctioning his human rights activities;
3. To put an end to the harassment against all human rights defenders in the People's Republic of China;
4. To conform with the provisions of the UN Declaration on Human Rights Defenders, adopted by the General Assembly of the United Nations on December 9, 1998, especially its Article 1, which states that "everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels", and above-mentioned Article 12.2;
5. To ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights standards and international instruments ratified by the People's Republic of China.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), requests your urgent intervention on the following situation in the People's Republic of China (PRC).
Brief description of the situation:

The Observatory has been informed by "Chinese Human Rights Defenders" (CRD) that Mr. Li Guohong, a laid-off workers' representative at Zhongyuan Oil Field, has been sent to a Re-education Through Labour (RTL) camp for one and a half years by the Zhongyuan Oil Field Public Security Bureau (PSB).

According to the information received, on October 31, 2007, Mr. Li Guohong had gone to Puyang City, Henan Province, where Zhongyuan Oil Field is headquartered, to learn about a lawsuit dismissed workers are going to file in Beijing against the oil field. Mr. Li went to Zhongyuan Oil Field PSB to learn more about the earlier detention of Zhongyuan Oil Field workers. There, he was himself promptly administratively detained for fifteen days. He was due to be released on November 16, 2007, but the authorities instead sent him to RTL. As of issuing this urgent appeal, no information could be obtained on the exact reasons for his detention.

Since 2001, Zhongyuan Oil Field, which is owned by China Petroleum and Chemical Corporation (Sinopec), has dismissed 10,000 workers without proper compensation. Since last year, representatives of the dismissed workers have petitioned higher authorities and, as a result, have suffered beatings and detention. Mr. Li is one of these representatives.

RTL is an administrative detention measure, according to which, without any proper legal procedures or trial, the PSB can send individuals to detention facilities for a maximum of four years. Detainees sent to RTL are deprived of their rights to legal counsel and appeal.

The Observatory expresses its deep concern about the arbitrary detention of Mr. Li Guohong and recalls that the denial of his rights to due process, free and fair trial and legal counsel is a flagrant violation of the International Covenant on Civil and Political Rights (Article 9), which China has signed but not yet ratified, and the Universal Declaration of Human Rights (Articles 9-11). His detention is also a flagrant violation of the provisions of the UN Declaration on Human Rights Defenders, adopted by the General Assembly of the United Nations on December 9, 1998, in particular of its Article 12.2, which provides that "the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration".

The Observatory also fears for Mr. Li Guohong's physical and psychological integrity as an increasing number of human rights defenders have been subjected to torture or ill-treatments by the authorities over the past years.
Actions requested:

Please write to the authorities in the People's Republic of China, urging them to:

i. Guarantee in all circumstances the physical and psychological integrity of Mr. Li Guohong;

ii. Ensure his immediate release since his detention is arbitrary as it merely aims at sanctioning his human rights activities;

iii. Put an end to the harassment against all human rights defenders in the People's Republic of China;

iv. Conform with the provisions of the UN Declaration on Human Rights Defenders, adopted by the General Assembly of the United Nations on December 9, 1998, especially its Article 1, which states that "everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels", and above-mentioned Article 12.2;

v. Ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights standards and international instruments ratified by the People's Republic of China.
