No.4005 ロシア:著名な政治活動家であり人権活動家が襲撃され銃殺されました。

(ジュネーブ・パリ発 12月5日)

 「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、ロシアにおける以下の状況に関して、皆様の緊急の働きかけをお願いします。

<事件の概要>

人権擁護家のための監視機構は信頼できる情報筋より、ダゲスタン共和国で人権擁護活動を行っていた有名な政治活動家のファリド・ババエフさんが襲撃され、死亡したという情報を入手しました。

情報によると、2007年11月21日午後9時頃、マハチカラ(ダゲスタンの首都)で、ロシア下院選挙にヤブロコ党から立候補していたババエフさんが同党本部から帰宅途中、何者かに銃撃されました。彼は頭部を撃たれ、重体の状態で病院に運び込まれ、その後意識不明になりました。数時間後に手術を受けましたが、2007年11月24日に死亡しました。

ファリド・ババエフさんは以前から人権擁護活動に熱心に関わっていました。とくに強制失踪、拷問、即決処刑、警察の横暴について調査していました。2007年8月にはダゲスタンで人権円卓会議を開催し、モスクワから有名な人権擁護家を招待しました。

彼はまた、ダゲスタンで重要な選挙キャンペーンも行っていました。

監視機構はロシアにおいて人権擁護家が極端な暴力を受け続けていることを裏付ける事件であるファリド・ババエフさんの死亡を憂慮し、1998年 12月9日に国連総会が採択した人権擁護家に関する宣言の第1条2項「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」を遂行するよう要請します。

監視機構は、欧州安全保障・協力機構(OSCE)加盟国のロシアは、人権擁護家と全国的人権組織へのOSCEの関わりの強化に関するOSCE議会総会決議(1)、とくに第8項「OSCE、その組織、フィールド・オペレーションおよび加盟国による人権擁護家に対する特別な注意、支援、保護の必要」を加盟国は認識するという規定を遵守しなければならないことを指摘します。

<行動要請>

 ロシア関係当局に以下の内容の要請をお願いします。

1.ファリド・ババエフさんの死亡に責任のある人びとを特定し、裁判に付し、法に基づき判決を言い渡すために、彼の死亡事件に独立した公正な調査を即時実施すること。

2.いかなる情況にあろうとも、ロシア連邦のすべての人権擁護家の心身の安全を保障すること。

3.ロシア連邦のすべての人権擁護家に対する嫌がらせ行為に終止符を打ち、いかなる場合においても、彼・彼女たちが本来の目的を不合理に妨害されることなく遂行できるよう保障すること。

4.ファリド・ババエフさんの家族に適切な補償が届くよう保障すること。

5.国連人権擁護家に関する宣言、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条と、「すべての人は、個々にまた他の者と共同して、すべての人権と基本的自由に関する意見、情報、知識を出版、発表もしくは他の者に伝える権利を有している」とした第6条(b)を守ること。

6.さらには、世界人権宣言およびロシア連邦が批准した国際文書に沿って、人権尊重と基本的自由を国内全土で保障すること。

1. To conduct an immediate, independent and impartial investigation into Mr. Farid Babaev's death in order to identify those responsible, bring them to justice and sentence them according to the law;
2. To guarantee in all circumstances the physical and psychological integrity of all human rights defenders in the Russian Federation;
3. To put an end to all acts of harassment against all human rights defenders in the Russian Federation and ensure in all circumstances that they be able to carry out their work without unjustified hindrances;
4. To guarantee that adequate reparation is provided to Mr. Babaev's family;
5. To comply with all the provisions of the United Nations Declaration on Human Rights Defenders, in particular with Article 1, which provides that "everyone has the right, individually and in association with others, to promote and to strive for the protection and realization of human rights and fundamental freedoms at the national and international levels", Article 6.b, which provides that "everyone has the right, individually and in association with others [...] freely to publish, impart or disseminate to others views, information and knowledge on all human rights and fundamental freedoms", as well as with the above-mentioned Article 12.2;

The Observatory for the Protection of Human Rights Defenders, a joint programme of the International Federation for Human Rights (FIDH) and the World Organisation Against Torture (OMCT), requests your urgent intervention in the following situation in the Russian Federation.

Brief description of the situation:

The Observatory has been informed by reliable sources about the attack against Mr. Farid Babaev, a prominent political activist involved in human rights activities in Dagestan, and his subsequent death.

According to the information received, on November 21, 2007, at around 9 p.m., in Makhachkala (capital of Dagestan), Mr. Babaev, who was running for the Russian State Duma elections under for Yabloko party, was returning back home from the Party Headquarters when unidentified assailants opened fire. He was then brought to hospital in a critical condition, suffering serious injury in his head, and subsequently fell in coma. A few hours later, Mr. Babaev underwent surgery. He died on November 24, 2007.

Over the past years, Mr. Farid Babaev, has been actively involved in human rights activities. In particular, he has been enquiring into enforced disappearances, torture, summary executions and police brutality. In August 2007, he had organised a roundtable for human rights in Dagestan, where he had invited famous rights defenders from Moscow.

Mr. Babaev had also organised a critical electoral campaign in Dagestan.

The Observatory expresses its deepest concern at Mr. Farid Babaev's death, which is further evidence of the ongoing acts of extreme violence against human rights defenders in the Russian Federation, and urges the authorities to "take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of his or her rights", in conformity with Article 12.2 of the United Nations Declaration on Human Rights Defenders, adopted by the UN General Assembly on December, 9, 1998.

The Observatory further recalls that as a Participating State of the Organisation for Security and Cooperation in Europe (OSCE), Russia must conform with paragraph 8 of the OSCE Parliamentary Assembly Resolution on Strengthening OSCE Engagement with Human Rights Defenders and National Human Rights Institutions[1], which states that the OSCE Participating States recognise "the need for particular attention, support and protection for human rights defenders by the OSCE, its Institutions and field operations, as well as by participating States".

Actions requested:

The Observatory urges the authorities of the Russian Federation to:

i. Conduct an immediate, independent and impartial investigation into Mr. Farid Babaev's death in order to identify those responsible, bring them to justice and sentence them according to the law;

ii. Guarantee in all circumstances the physical and psychological integrity of all human rights defenders in the Russian Federation;

iii. Put an end to all acts of harassment against all human rights defenders in the Russian Federation and ensure in all circumstances that they be able to carry out their work without unjustified hindrances;

iv. Guarantee that adequate reparation is provided to Mr. Babaev's family;

v. Comply with all the provisions of the United Nations Declaration on Human Rights Defenders, in particular with Article 1, which provides that "everyone has the right, individually and in association with others, to promote and to strive for the protection and realization of human rights and fundamental freedoms at the national and international levels", Article 6.b, which provides that "everyone has the right, individually and in association with others [...] freely to publish, impart or disseminate to others views, information and knowledge on all human rights and fundamental freedoms", as well as with the above-mentioned Article 12.2;

vi. Comply with the provisions of the Document of the Copenhagen Meeting of the 2nd Conference on the Human Dimension of the Cooperation and Security Conference in Europe (CSCE) (1990), and uphold in all circumstances the principles and provisions enshrined in the international and regional human rights instruments ratified by the Russian Federation and which, in particular, guarantee freedoms of association, demonstration, expression and opinion, in particular the European Convention on Human Rights and the International Covenant on Civil and Political Rights;

vii. More generally, ensure in all circumstances the respect for human rights and fundamental freedoms in accordance with in accordance with the Universal Declaration of Human Rights and with international and regional human rights instruments ratified by the Russian Federation.
